Pursuant to Chapter 96 of the Public Laws of 1973, as amended, State of Rhode Island, there is hereby created a Sewer Board of Review for the Town.
The Board of Review shall consist of three members appointed by the Town Council. Said members shall be first appointed for terms of three, two and one years, respectively; thereafter, members shall be appointed for three-year terms as the first terms expire.
The Chairman of the Sewer Board of Review shall be selected by the Town Council and shall serve in such capacity at the pleasure of the Town Council.
The Sewer Board of Review shall meet at least once each month of the year, unless it has no business to conduct, at which occasion a meeting may be canceled. The Board shall keep an accurate record of its proceedings, which shall be available for public inspection.
The Sewer Board of Review shall be governed by the following procedures in the execution of its functions:
A. 
The Board shall receive and act upon the appeal of any person aggrieved by:
(1) 
Sewer assessment, provided such appeal is received within 60 days after the mailing of notice of assessment by the Town; or
(2) 
Within 30 days after giving or mailing of notice of an order under Section 17 of Chapter 96 of the 1973 Public Laws of the state.
B. 
If the Board determines that such assessment charge or order is unwarranted in whole or in part, it shall annul or modify the same and make such order as justice may require; otherwise it shall affirm the same. Whatever the Board's decision in any case, such decision shall be reduced to writing and provided to the appellant within 10 days of the decision, with copies of such provided to the Town Clerk, the Town Treasurer, the Town Tax Assessor, the Town Council and the Sewer Authority.
C. 
Within 30 days after notification of the Board's decision, any person aggrieved, which may include the Sewer Authority, may appeal to the superior court, which court shall have the same power to annul, modify, enter further order or affirm as the Sewer Board of Review.
The Sewer Board of Review shall adopt rules for the orderly transaction of its business; such rules shall be filed with the Town Council and the Town Clerk.
