It has become a common practice of persons within
Ventnor City to install apparatus and in connection therewith to place,
erect, construct or stretch wires over, across, under or beneath or
adjacent to electric light wires which, in case of an accident, would
become detached or otherwise or might come into contact with high-tension
current and cause injury to property or life. This practice is dangerous,
and it is deemed advisable, necessary and proper to guard against
and protect against such dangers.

From and after the passage of this chapter, it shall
be unlawful to erect, construct, maintain or have any aerial wire
or paraphernalia which shall extend over, across, under or beneath
or adjacent to any electric light wire or other wire calculated to
or intended to carry a high-tension electric current or to so construct
and maintain the same which shall or would, by reason of an accident
or breaking down of said wire, electric light wire or otherwise, come
in contact, thereby becoming prejudicial and dangerous to life or
property within Ventnor City.

No wiring or apparatus shall be installed, erected or constructed without a permit first being obtained therefor and the same being inspected by the Electrical Subcode Official, for which permit and inspection there shall be paid a fee in the amount set forth in Chapter 114, Fee Schedule.

Any person or persons having control of any
wire or apparatus or the building or property whereon the same or
part thereof shall be, upon notice from the City of Ventnor City,
immediately shall remove or cause to be removed any radio wire by
whatsoever name may be designated and upon failure to do so shall
forfeit and pay a penalty of $100 for each and every day the same
will remain thereafter, said penalty to be imposed by the Mayor or
the Municipal Judge of the City before whom such complaint shall be
made, or the City of Ventnor City, by its agent or employee, may remove
the same. In addition to or as a substitute for the previously mentioned
fine, the imposition of community service shall be authorized as an
additional penalty, which community service shall not exceed 90 days.
