The Village of Elmira Heights contracts for the pickup and removal of refuse for the Village residents. The cost of refuse removal has consistently risen over the past decade causing concern over the future effect of cost removal on property taxes within the Village. It is the desire of the Village Board of Trustees to control property tax increase and spread the cost of refuse collection among both property owners and renters.
The Village Board of the Village of Elmira Heights finds the proposed garbage sticker program to be in the best interest of Village residents and hereby adopts said program as follows:
A. 
The Village will continue to contract for the collection of refuse for Village properties.
B. 
Each single-family residence will be allowed to place three bags of garbage per week upon the curb for collection; each multiple-family residence will be allowed to place two bags per unit per week upon the curb for collection.
C. 
All bags placed upon the curb for collection must have attached thereto a garbage sticker issued by the Village of Elmira Heights.
D. 
Each sticker shall bear a charge as set by resolution by the Board of Trustees from time to time[1] and shall be purchased from the Village Clerk's office in multiples of two at posted hours.

E. 
No resident shall be allowed to purchase more stickers than would be allowed pursuant to the weekly allotment as described above for the fiscal year during which the stickers are purchased.
F. 
Stickers will be valid only during the fiscal year during which they are purchased, with a two-week grace period at the beginning of each subsequent fiscal year.
G. 
The Village will not repurchase any unused stickers.
H. 
The Village reserves the right to increase or decrease the cost per sticker for each fiscal year without the requirement of a formal amendment to this article. Any such increase or decrease shall be accomplished by resolution of the Board of Trustees at a regularly scheduled or special Village Board meeting and shall be prominently posted and advertised.

Any person who violates any provision of this article shall, upon conviction, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.
