The Town Board of the Town of North Salem finds that retail establishments which are open to the public on a twenty-four-hour basis or which are open for unusually late hours may cause serious disturbance to the peace, safety and well-being of neighboring residential properties and persons residing therein. The purpose of this chapter is to impose limited restrictions on the business hours maintained by such establishments but without restricting the usual and customary business hours maintained by restaurants and taverns.
No retail business of any kind, including gasoline service stations and automobile repair shops, shall be open to the public between the hours of 11:00 p.m. and 6:00 a.m.
The restrictions in § 182-1 of this chapter shall not apply to duly licensed establishments serving food or drink to the public for on-premises consumption or to businesses providing emergency services.
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
