A.
DANCE
DANCE HALL
Definitions. The following definitions shall be applicable
in this section:
A public dance is any dance to which the public generally without
restriction may gain admission with or without payment of a fee.
A public dance hall is any place at which a public dance is held.
B.
License fee. The license fee shall be as set by the Village
Board.
C.
Exemptions. No license shall be required for dances conducted
under the supervision and control of a public or parochial school or college,
church, parent-teacher association, fraternal or social organization conducted
on a nonprofit basis for its guests, or for any benevolent or fraternal organization
operating a dance for benevolent or charitable purposes. At least five teachers
or parents shall be present to supervise dances given by a parent-teacher
association.
D.
Investigation of premises. The Village Clerk-Treasurer
shall refer all applications for dance or dance hall licenses to the Chief
of Police and the Building Inspector, who shall inspect the premises proposed
to be licensed to see that such premises comply with all Village ordinances
and state laws and health regulations. Such officers shall report in writing
to the Village Clerk-Treasurer their recommendations as to issuance of the
license.
E.
Sanitation and lighting. All public dance halls shall
be kept at all times in a clean, healthy and sanitary condition, and all stairways
and other passages, and all rooms connected with a dance hall, shall be kept
open and well lighted.
F.
Stopping dances. The Chief of Police, or any law enforcement
officer or other person of competent authority, shall cause the place, hall
or room where any dance or ball is held to be vacated whenever any law of
the Village or state with regard to public dances and public halls is being
violated or whenever any indecent act shall be committed or when any disorder
of a gross, violent or vulgar character shall take place.
G.
Law to be obeyed. The owner of every hall, room or other
space rented or used for public dances, as well as the person or association
giving the dance, shall see that the provisions of this section and all other
laws and regulations relating to public dances and public dance halls are
complied with.
H.
Duties of floor manager. Any person conducting a public
dance or renting a public dance hall shall have a person in control of the
premises continuously from a half hour before dancing begins until the dance
hall is closed. The floor manager shall see that decency and good taste are
maintained and that disorderly or objectionable conduct is not tolerated and
shall take efficient steps promptly to remove objectionable persons and stop
objectionable practices.
I.
Closing hours. All public dances shall be discontinued
and all public dance halls closed on or before 2:00 a.m., except on January
1 when the hour shall be 3:00 a.m.
A.
PUBLIC ENTERTAINMENT
Definition. As used in this section, the following terms
shall have the meanings indicated:
Any sporting activity, show, theater, circus, carnival, concert or
similar activity to which the public is admitted upon payment of an admission
fee or other thing of value.
B.
License fee. The license fee shall be as set by the Village
Board.
C.
Exceptions.
(1)
Whenever any public entertainment is part of a larger
public entertainment or is conducted on premises which are licensed hereunder,
no additional license shall be required.
(2)
Entertainments of a scientific, historical or literary
character or entertainments conducted under the management of citizens of
the Village for religious, cultural, scientific or charitable purposes or
authorized school or college functions shall not be required to obtain a license.
A.
ENTERTAINMENT/AMUSEMENT/VENDING DEVICE
OPERATOR
Definitions. The following terms shall have the following
meanings when used in this section:
Any machine, including, without limitation, a pinball machine, a
jukebox, or a game, including but not limited to a pool table, a billiard
table, a foosball table, a shooting gallery or miniature golf course, which
upon the insertion of a coin or slug operates or may be operated for use as
a game, contest, amusement or entertainment of any description. Such definition
shall also include any machine or game as enumerated above for which a fee
is charged and given to an operator or an employee of said operator who then
allows the use of such machine or game.
Any person, firm or corporation owning, operating or managing one
or more entertainment/amusement/vending devices installed or set up for use
in the Village.
B.
Age limit. No license shall be issued to a person under
the age of 18 years.
C.
Vending machine location. No vending machine shall be
located outside of a building in the R-1 Residence District.
D.
Licensing form.
(1)
Licenses required. Any person, firm, association, partnership
or corporation owning, installing, maintaining or permitting the maintenance
of any such entertainment/amusement/vending device on premises owned or under
the control, supervision or management of such person, firm, corporation,
association or partnership shall license such entertainment/amusement/vending
device.
(3)
Information. The license applicant shall submit such
information as shall be required by the Village Clerk-Treasurer to the Village
Clerk-Treasurer to permit the Clerk-Treasurer to properly identify the entertainment/amusement/vending
device, operator or premises to be licensed.
(4)
Registration symbol. The Village Clerk-Treasurer shall
issue to the applicant an appropriate registration symbol of such form and
design as shall permit the same to be securely attached to any entertainment/amusement/vending
device licensed.
E.
Transfer. The Village Clerk-Treasurer is authorized to
permit the transfer of the license issued for one entertainment/amusement/vending
device to another entertainment/amusement/vending device upon a good and proper
showing that the entertainment/amusement/vending device for which such license
is transferred has been taken out of use in the Village and upon the payment
of a transfer fee as set by the Village Board, and no such entertainment/amusement/vending
device so taken out of use in the Village shall be placed back in use until
a license has been secured for the same.
F.
Record. The Village Clerk-Treasurer shall keep an appropriate
record of the licensing of each entertainment/amusement/vending device showing
the name and number and such other information as he deems necessary concerning
each machine or game license. He shall also keep a similar record of all entertainment/amusement/vending
devices for which transfers have been issued or authorized.
G.
Wagering and prizes not allowed. No operator or employee
of an operator shall permit the wagering or gambling of money, goods or merchandise
upon the result of a game or machine played, or upon the test of skill, nor
shall any such person, for himself or for any other operator or employee,
pay any money, goods, merchandise or tokens to any person playing the entertainment/amusement/vending
device. All other ordinances of the Village relative to gambling and the effect
of gambling devices shall remain in full force and effect.
H.
Operator's responsibilities.
(1)
All buildings containing entertainment/amusement/vending
devices shall be kept at all times in a clean, healthy and sanitary condition
and all stairways and other passages and all rooms connected with said premises
shall be kept open and well lighted.
(2)
The premises and area immediately surrounding any building
containing an entertainment/amusement/vending device shall be kept at all
times in a clean, healthy and sanitary condition.
(3)
The operator of any entertainment/amusement/vending device
shall be held responsible for the full compliance of the requirements of this
section and any violation of this section which may occur in his premises,
whether he participated in such violation or not.
I.
Police action.
(1)
License deemed entry consent. Any law enforcement officer
may, in the discharge of his duties, enter, at any time, any premises in which
an entertainment/amusement/vending device is located. The application for
a license or registration is deemed to be a consent to such entry.
(2)
Seizure. Any law enforcement officer may seize or cause
to be seized any entertainment/amusement/vending device upon which there is
not affixed the proper registration symbol.
J.
Registration symbol; alteration unlawful. Any person who counterfeits, changes or alters any registration symbol or who transfers such registration symbol from one entertainment/amusement/vending device to another without having previously registered such transfer with the Village Clerk-Treasurer shall, upon conviction, be penalized in the manner and to the extent as provided in Chapter 1, General Provisions, § 1-5.
