As used in this chapter, the terms "article," "jewelry," "pawnbroker," "secondhand," "secondhand article dealer" and "secondhand jewelry dealer" shall have the meaning provided in § 134.71(1), Wis. Stats.
A person wishing to operate as a secondhand article dealer or a secondhand jewelry dealer and have a principal place of business in the Village of Orfordville shall apply for a license to the Village Clerk-Treasurer. A person wishing to operate as a pawnbroker in the Village of Orfordville shall apply for a license to the Village Clerk-Treasurer. The Clerk-Treasurer shall furnish application forms as prescribed by § 134.71(5) and (12), Wis. Stats.
The Police Department shall investigate each applicant for a pawnbroker's, secondhand article dealer's or secondhand jewelry dealer's license to determine whether the applicant has been convicted within the preceding 10 years of a felony or within the preceding five years of a misdemeanor, statutory violation punishable by forfeiture or county or municipal ordinance violation described under § 134.71(5)(c), Wis. Stats., and, if so, the nature and date of the offense and the penalty assessed. The Police Department shall furnish the information derived from that investigation in writing to the Clerk-Treasurer.
The Village Board shall grant the license if all of the requirements of § 134.71, Wis. Stats., have been met. No license issued under this chapter may be transferred. The term of a license shall be as prescribed in § 134.71(7)(c), Wis. Stats.
Pawnbrokers , secondhand article dealers and secondhand jewelry dealers shall comply with all requirements of § 134.71(8), Wis. Stats.
The owner of any premises or land upon which two or more persons operate as secondhand article dealers may obtain a secondhand article dealer mall or flea market license for the premises or land in accordance with § 134.71(9), Wis. Stats.
The Village Board may revoke any license issued by it under this chapter for fraud, misrepresentation or false statement contained in the application for a license or for any violation of this chapter or § 134.71, 943.34, 948.62 or 948.63, Wis. Stats.
The annual fees for a pawnbroker's license, secondhand article dealer's license, secondhand jewelry dealer's license, and secondhand article dealer mall or flea market license are set by the Village Board from time to time.
