As used in this article, the following terms shall have the meanings
indicated:
Any complex of whatever nature of four or more stories.
Each owner of a high-rise, as defined herein, and each owner of elderly
housing, regardless of the number of stories, shall develop a written fire
safety plan which shall address, among other things, evacuation procedures
and elimination of fire hazards. Said plan shall be reviewed and approved
by the appropriate Fire Department. After approval, the plan shall be distributed
to all tenants of the building. Any updates to the fire safety plan shall
be reviewed and approved by the appropriate Fire Department and distributed
to all tenants of the building.
Each owner of a high-rise, as defined herein, and each owner of elderly
housing, regardless of the number of stories, shall designate, within 30 days
from date of notification by the appropriate Fire Department, an individual
to confer with the Fire Department on, among other things, proper evacuation,
notification of the Fire Department in case of a fire and elimination of fire
hazards. Such person shall be known to the Fire Department as a "fire safety
person." Within two weeks from such notification from the owner of the name
of said fire safety person, the Fire Department shall instruct this person
as to proper fire procedures for said high-rise or elderly housing.
Each owner shall have posted at each stairwell landing and exit from
each floor Fire Department approved signs with fire evacuation procedures.
The fire safety person or owner or other designated representative of
the owner of a high-rise, as defined herein, or of elderly housing, regardless
of the number of stories, shall inspect for condition and readiness of use
for the purposes of fire protection, especially for the protection of human
life and property, the alarm boxes, all emergency exits, stairways and passageways,
and all automatic fire and smoke doors to determine operational condition,
and all portions of standpipe and sprinkler systems and portable fire extinguishers,
and shall further inspect all parts of the premises for accumulations of rubbish
and maintain the premises free of the same at all times, and maintain a written
log of all inspections which log shall be available for Fire Department inspection.
The fire safety person or owner shall advise the Fire Department as
to which floors and specific apartments are occupied by elderly or handicapped
persons who will need assistance in being evacuated in case of a fire.
Any person who violates any provision of this article shall be fined
not more than $100 per day for each day the violation exists. Each day of
noncompliance with any provision of this article shall be considered a separate
and distinct violation.
