Every applicant for a change of zone, variance, special permit, approval
of a plat, exemption from a plat or official map, site plan approval or any
other license or permit shall, when making such application to the appropriate
agency of the Village of Lake Grove, submit an affidavit certifying the name
and address of each state or local officer or employee in Suffolk County interested
in the application, if any.
As used in this chapter, the following terms shall have the meanings
indicated:
Any corporation, domestic or foreign, whether business, membership
or organized pursuant to special legislation, but excluding any corporation
whose stock is traded on any regularly organized stock market as defined by
Rule 4533 of the Civil Practice Law and Rules.
A person is interested in an application when he or his spouse or
a person by consanguinity related to either of them within the third degree:
Is an owner, contract vendee, lessee of or a holder of an instrument
creating an encumbrance upon the real property which is the subject of the
application.
Is an officer, director or stockholder (legally or beneficially) of
a corporation which is the owner, contract vendee, lessee of or a holder of
an instrument creating an encumbrance upon the real property which is the
subject of the application, or has an agreement to purchase stock of such
a corporation.
Is an employee of an owner, contract vendee, lessee of or a holder of
an instrument creating an encumbrance upon the real property which is the
subject of the application.
Is a member of a partnership, joint venture or association which is
the owner, contract vendee, lessee of or a holder of an instrument creating
an encumbrance upon the real property which is the subject of the application,
or has an agreement to purchase an interest in the partnership, joint venture
or association.
Has an agreement, express or implied, whereby the amount of his compensation
for services is dependent or contingent upon the granting of the application.
All officers, elected or appointed; all special counsel; all members
of boards, commissions or committees, whether paid or unpaid; all other persons
whose salaries are paid by the state or local municipality within Suffolk
County; members of boards and commissioners of local public authorities or
other public corporations within Suffolk County, but not including volunteer
firemen or civil defense volunteers.
In the event that there is any change in any matter set forth in the
submitted affidavit after filing same but before the public hearing, the affiant
shall submit a supplemental affidavit within 72 hours after such change or
at the public hearing, whichever is earlier.
Any person committing an offense against any provision of this chapter
shall, upon conviction, be guilty of a violation pursuant to the Penal Law
of the State of New York, punishable by a fine not exceeding $250 or by imprisonment
for a term not exceeding 15 days, or by both such fine and imprisonment.
