As used in this chapter, the following terms shall have the meanings indicated:
NOXIOUS
Physically harmful or destructive to living beings.
NOXIOUS PLANTS
Harmful, distasteful or obnoxious plants, such as, but not limited to, ragweed, goldenrod, timothy, ryegrass, thistle, Kentucky bluegrass, Bermuda grass, poison ivy, poison oak or poison sumac.
A. 
Surface and subsurface water shall be appropriately drained to protect buildings and structures and to prevent the development of stagnant ponds. Gutters, culverts, catch basins, drain inlets, stormwater sewers, approved combined storm and sanitary sewers or other satisfactory drainage systems shall be utilized where necessary. No roof, surface or sanitary drainage shall create a structural, safety or health hazard by reason of construction, maintenance or manner of discharge nor be in violation of any law, ordinance or rule and regulation of the village.
B. 
Fences must be maintained and kept in an upright condition and in a state of good repair. Gates and openings to the property must present a proper working condition or be repaired. All graffiti existing thereon must be removed.

C. 
Steps, walks, driveways, parking spaces and similar paved areas shall be maintained so as to afford safe passage under normal use and weather conditions. Any holes or other hazards that may exist shall be filled or necessary repairs or replacement made.
D. 
Any accumulation of snow, ice or a combination thereof on sidewalks shall be removed by the occupant of the adjoining premises within four hours of the cessation of the snowfall.

E. 
Yards, courts and vacant lots shall be kept clean and free of physical hazards, rodent harborage and infestation. They shall be maintained in a manner that will prevent dust or other particles from being blown about the neighborhood. Open wells, cesspools or cisterns shall be securely closed or barricaded from access to the public pursuant to provisions of the Village Code.
F. 
Heavy undergrowth and accumulations of plant growth which are noxious or detrimental to health shall be eliminated. Any trees or portions thereof located on private property and constituting a hazard to personal property shall be removed.

G. 
All landscaping shall be maintained so that lawns, hedges, bushes and trees shall be kept trimmed regularly during the growing season and free from becoming overgrown and unsightly. Lawns must be kept at a height no greater than four inches from the ground surface. When such lawns, hedges, bushes and trees shall die or otherwise be destroyed, they shall be replaced.

H. 
No outside storage or accumulation of garbage, crates, rubbish, refuse or debris shall be permitted at any time, and all such garbage, crates, rubbish, refuse or debris shall be kept inside the building or buildings on the premises or in an acceptable enclosure and shall be regularly collected and removed from the premises.
I. 
No shopping baskets, carts or wagons shall be left unattended or standing in open areas, but shall be regularly collected by the occupant of each unit, store, supermarket or business and removed to the interior of the buildings. Any such baskets, carts or wagons discovered off the premises shall be deemed abandoned to the village and will be appropriated by the village, returnable upon the payment of a fee of $25.
J. 
No person shall cause litter, debris and/or hazardous waste to be thrown or deposited in or upon public or private stormwater runoff recharge basins, whether said recharge basin is privately or publicly owned.

K. 
No person shall sweep into or deposit into any gutter, street or any public place within the village the accumulation of any litter or debris from any building or lot or from any public or private sidewalk or driveway. Persons owning or occupying property shall keep the sidewalk and front of their premises free of litter and debris and in a state of good repair.

L. 
No person shall leave outside of any building or dwelling, in a place accessible to children or any other persons, any abandoned, unattended or discarded icebox, refrigerator or any other container of any kind which has an airtight snap lock or other device thereon, without first removing said snap lock or doors from said icebox, refrigerator, appliance or other type of container.

A. 
Grounds, buildings and structures shall be maintained free of insect, vermin and rodent harborage and infestation. Methods used for exterminating insects, vermin and rodents shall conform to generally accepted practice, as approved and recommended by the State of New York.
B. 
Where the potential for rodent or vermin infestation exists, windows and other openings in basements and cellars shall approximately be screened with wire mesh or other suitable materials.
C. 
All commercial establishments shall be required to show evidence of a rodent control program.
All buildings, dwellings, dwelling units, multiple dwellings, yards, courts, open areas and vacant lots which are in violation of this chapter are hereby declared to be a nuisance and such nuisances shall be abated by being corrected, made sanitary, repaired, vacated or demolished in accordance with the orders of the Village Board.
A. 
Owners of premises shall be responsible for compliance with the provisions of this chapter and shall remain responsible therefor regardless of the fact that this chapter may also place certain responsibilities on operators and occupants and regardless of any agreements between owners and operators or occupants as to which party shall assume such responsibility.
B. 
Owners and operators of multiple dwellings shall be responsible for proper installation, maintenance, condition and operation of service facilities and for furnishing adequate heat, domestic hot water supply and flush toilets where they have contracted to do so.
C. 
Whenever any person or persons shall be in actual possession of or have charge, care or control of any property within the village as executor, administrator, trustee, guardian, operator or agent, such person shall be deemed and taken to be the owner or owners of said property within the true intent and meaning of this chapter and shall be bound to comply with the provisions of this chapter to the same extent as the record owner; and notice to any such person of any order or decision of the Building Department shall be deemed and taken to be a good and sufficient notice as if such person or persons were actually the record owner or owners of such property. In instances where an occupant is responsible or shares responsibility with the owner for the existence of one or more violations of this chapter, said occupant shall be deemed and taken to be an owner within the true intent and meaning of this chapter.
Occupants of dwelling units shall be responsible for compliance with this chapter in regard to the following:
A. 
Maintenance of that part of the premises which is occupied or controlled in a clean, sanitary and safe condition.
B. 
Maintenance of all plumbing, cooking and refrigeration fixtures and appliances as well as other building equipment and storage facilities in that part of the premises occupied or controlled in a clean and sanitary condition, and reasonable care in the operation and use thereof.
C. 
Keeping exits from the dwelling unit clear and unencumbered.
D. 
Disposal of garbage and refuse into provided storage facilities in a clean and sanitary manner, in accordance with the provisions of this chapter and other rules, regulations, laws and ordinances of the Village of Lake Grove.
E. 
Extermination of insects, rodents or other pests within the dwelling unit.
F. 
Maintenance of yards, lawns and courts in a clean, sanitary and safe condition and free from infestation insofar as said occupant occupies or controls said yards, lawns and courts or any parts thereof.
G. 
Elimination of all prohibited uses in that part of the premises which is occupied or controlled or to which there is access.
