A.
In J Business 3 District, no building, structure or
premises shall be used or occupied, and no building or part thereof
or other structure shall be erected or altered, unless otherwise provided
in this chapter, except for one or more of the following uses:
(1)
Permitted principal uses.
(a)
All principal uses permitted and as regulated
in J Business 2 District.
(2)
Permitted accessory uses, located on the same lot
with the permitted principal use.
(a)
All accessory uses permitted and as regulated
in J Business 2 District.
B.
All buildings, structures or premises shall be erected in a continuous, connected row of buildings for a commercial or shopping center, and no freestanding buildings or structures shall be constructed, built or erected, detached from the main group of buildings or structures, on any part of the lot, plot or property, between the setback line and the front of the main row or group of buildings or structures nor on either side of said main row or group of buildings or structures, except by special permit from the Village Board after consideration and recommendation of the Planning Board; and further provided that such buildings or structures shall not in any way reduce the lot area usually required for the number of parking spaces for the entire commercial or shopping center nor increase the building area of the total lot, plot or property as provided in § 175-42 of this article.
In J Business 3 District, no building or structure
shall be erected or altered to a height in excess of 35 feet or 21/2
stories.

In J Business 3 District, the total building area shall not exceed 15% of the total lot area, excluding the flag strip portion of flag lots as defined in § 175-1, Definitions and words use.
In J Business 3 District, no building, structure
or premises shall be used or occupied and no building or structure
shall be erected or altered on a lot having an area of less than five
acres.
In J Business 3 District, there shall be a front
yard having a depth of not less than 50 feet.

In J Business 3 District, no side yards are
required, except, however, that where one is used as a driveway or
passageway for vehicles, it shall be at least 25 feet in width, and
except further that where the side lot line abuts any lot or land
area in a residence district, it shall be at least 100 feet in width,
and a thirty-foot strip adjoining such residence district shall be
maintained as a landscaped buffer area. Notwithstanding other provisions
of this chapter, where property in the J Business 3 District abuts
any lot or land area in a residence district, there shall be provided
along such property line an opaque wall not less than eight feet in
height and a solid evergreen planting strip.

In J Business 3 District, there shall be a rear
yard having a minimum depth of 30 feet, except, however, that where
the rear lot line abuts any lot or land area in a residence district,
it shall be at least 150 feet in depth, and a minimum thirty-foot
strip adjoining such residence district shall be maintained as a landscaped
buffer area, including a solid evergreen planting strip. Where property
in the J Business 3 District abuts any lot or land in a residence
district, there shall also be provided along such property line, an
opaque wall not less than eight feet in height.
A.
In each case where a building, structure or use or alteration thereof is proposed in this district, the Building Inspector shall refer the site plan of the proposed building, structure or use or alteration thereof to the Village Planning Board for its review as provided in Article X of this chapter.
B.
No site plan shall be approved and no building permit
shall be issued in J Business 3 District where the application and
the site plan submitted show that the property is located within 200
feet of any public or parochial school, public library, church, synagogue
or other place of worship, firehouse, or federal, county, state, town
or village building, except by special permit and approval of the
Village Board.
