The Town Board of the Town of Ossining finds that it is in the best interests of the health, safety and welfare of the citizens of the Town of Ossining to require that signs dealing with the occupancy limits in places of public assembly be conspicuously posted.
As used in this chapter, the following terms shall have the meanings indicated:
OWNER
The legal owner of the real property upon which the place of public assembly is located. If said place of public assembly is leased, then the "owner" shall be the lessee or lessees, if an individual or individuals, or if a corporation, the owner shall be all the stockholders of such corporation.
PLACES OF PUBLIC ASSEMBLY
Any private recreation facility or any eating or drinking establishment located in the unincorporated area of the Town of Ossining, Westchester County, New York.
A. 
All places of public assembly located within the unincorporated area of the Town of Ossining shall post a sign or signs as directed by the Building Inspector of the Town of Ossining, which such signs shall state the occupancy limits of such places of public assembly in accordance with the Building Code of the State of New York. Such signs shall be issued by the Building Inspector of the Town of Ossining and shall be in conformance with the Building Code of the State of New York pertaining to space requirements in places of public assembly.
B. 
Such signs must be posted in a conspicuous location so that any patron using such place of public assembly shall be able to easily read such sign.
C. 
The continuous and uninterrupted posting of such signs as directed by the Building Inspector of the Town of Ossining shall be the sole responsibility of the owner.
D. 
No owner shall suffer or permit the occupancy of a place of public assembly by more people than shall be determined herein by the Building Inspector as the occupancy limit.[1]

Any owner violating any provision of this chapter shall be guilty of a violation punishable by a fine not to exceed $250 or by imprisonment for not more than 15 days, or both. Each day that the said violation is permitted to continue shall constitute a separate violation.
