The purpose of this article is to require the registration of all private persons and entities who are engaged in the business of hauling trash and/or debris from locations within the Borough of Lansdowne. It is the opinion of the Borough Council of the Borough of Lansdowne that the hauling of trash and/or debris is a matter affecting the health, safety and welfare of the residents of the Borough, and that the registration of all persons and entities engaged in such activity is necessary to protect these interests. This article is intended to amend the existing provisions of the Lansdowne Borough Code relating to solid waste, currently codified at Chapter 280 of said Lansdowne Borough Code.
Every person or entity engaged in the business of hauling trash and/or debris from one or more locations within the Borough of Lansdowne shall at all times be registered with the Borough. Such registration shall include, but not be limited to, the following information:
A. 
The name, address, telephone number, fax number and e-mail address of the registrant,
B. 
If the registrant is a business entity of any kind, the name, business address, business telephone numbers, business fax numbers and e-mail addresses of any persons in charge of the operations of the business entity within the Borough of Lansdowne;
C. 
The make, model and vehicle license number of any vehicle used in the Borough of Lansdowne for hauling trash and/or debris;
D. 
The locations from which the registrant hauls trash and/or debris.
Every registrant shall pay an annual registration fee which shall be set by resolution passed by the Borough Council from time to time. The registration fee shall be the same for all registrants and shall not be dependent upon the volume of trash and/or debris hauled by the registrant or upon the income realized by the registrant from hauling trash and/or debris from locations within the Borough of Lansdowne.
No person or entity required to register with the Borough shall collect or haul trash and/or debris except during the hours of operation set by the Borough Council by resolution as it deems fit.
Every person or entity who engages in the business of hauling trash and/or debris from locations within the Borough shall comply with all other applicable laws and regulations of the Borough, including but not limited to the Borough's laws and regulations relating to recycling.
