Town of Ledgeview, WI Chapter 118 Vehicles and Traffic

Article I Official Traffic Map; Speed Limits; Weight Limitations

§ 118-1 Official Traffic Map.

A. Established. The Town of Ledgeview hereby establishes an Official Traffic Map dated April 2, 2012, for the Town upon which shall be indicated "no parking" areas, "restricted parking" areas, stop signs, arterial intersections, yield signs, special speed limits, one-way highways, school crossings and all other restrictions or limitations contained in this chapter, as from time to time amended or modified by the Town when the laws of the state require the erection or use of official traffic control devices to enforce such restrictions or limitations.

B. Violations prohibited. When official traffic control devices giving notice of the restrictions, prohibitions and limitations shown on the Official Traffic Map are erected and maintained in accordance with this section, a violation of the restriction, prohibition or limitation shown on the Official Traffic Map shall be a violation of this chapter.

C. Maintenance and display. A copy of the Official Traffic Map shall be maintained and displayed in the office of the Public Works Department.

D. Additions. The Town Board may from time to time make additions to or deletions from the Official Traffic Map, and the Public Works Department shall keep such Official Traffic Map current.

§ 118-2 Speed limits established.

The Town Board, pursuant to § 349.11, Wis. Stats., may establish speed limits on Town roads different from the statutory speed limit. Such speed limits shall be based upon an engineering and traffic study and shall be shown on the Town of Ledgeview Official Traffic Map established under § 118-1.

§ 118-3 Weight limitations.

A. Purpose. The purpose of this section is to provide a uniform method to direct heavy truck traffic away from public streets and roads in the Town of Ledgeview that are structurally unsuited for such traffic or where such traffic would adversely impact the safety and welfare of residential areas.

B. Definitions. As used in this section, the following terms shall have the meanings indicated:

AUTHORITY

Any person or persons authorized by the Town of Ledgeview to be responsible for road maintenance in the Town of Ledgeview.

HEAVY TRUCK TRAFFIC

All vehicles operating completely on pneumatic tires and all vehicles or combination of vehicles, other than motor buses, designed or used for transporting property of any nature and having a gross weight of more than 8,000 pounds.

C. Special or seasonal weight limitations. Pursuant to the authority of § 349.16, Wis. Stats., the Town Board hereby designates the Public Works Operator as the "authority" in charge of maintenance of streets and highways in the Town and authorizes such, when necessary, to impose special weight limitations on any highway or street or its portion within the Town which, because of weakness of the roadbed due to deterioration or climatic conditions or other special or temporary condition, including, but not limited to, damage to the street caused by heavy volumes of truck traffic or damage to streets not completely constructed, would likely be seriously damaged or destroyed in the absences of such special limitation. The Public Works Operator shall, upon making determinations to impose special weight limitations in accordance herewith, erect signs on or along the highways or streets on which it is desired to impose the limitation sufficient to give reasonable notice that a special weight limitation is in effect and the nature of that limitation. All weight limitation signs and their erection shall comply with rules of Wisconsin Manual on Uniform Traffic Control Devices.

D. Routes prohibited to heavy truck traffic. It shall be unlawful for any person or company to operate any motor vehicle on the following Town of Ledgeview roads (having a gross weight of (more than 8,000 pounds) except when necessary for the purpose of obtaining orders, delivering or moving supplies or other necessary commodities to or from any place of business or residence fronting on any such road, and except when necessary for the propose of leaving or returning to the terminal or place of garaging of any such vehicle. When it is necessary for the operator of such a vehicle to travel on a street prohibited to heavy truck traffic, such operator shall leave and reenter the route at the point closest to the immediate destination.

(2) Swan Road from Heritage Road (CTH X) to Dickinson Road;

(3) Ledgeview Road, in its entirety;

(4) Creamery Road from Heritage Road (CTH X) to Kaftan Road;

(5) Bower Creek Road from Dickinson Road (CTH G), in its entirety;

(6) Dollar Lane, in its entirety;

(7) Dollar Road, in its entirety;

(8) Whisper Lane, in its entirety;

(9) Scray Hill Road from 2045 Scray Hill Road to Lime Kiln Road (CTH V);

(10) Lime Kiln Road (CTH V) from Dickinson Road (CTH G) to Scray Hill Road;

(11) Pine Grove Road, in its entirety;

(12) Glenmore Road, in its entirety;

(13) Hidden Valley Lane, in its entirety;

(14) Hidden Valley Court, in its entirety;

(15) Elmview Road from Pine Grove Road to Dutchman Road/Creekend Lane;

(16) Shadow Lane from Elmview Road (CTH MM) to Main Street (CTH R);

(17) Trestle Road, in its entirety;

(18) Wall Street from Main Street (CTH R) to curve;

(19) Tordeur Lane, in its entirety;

(20) Sportsman Road, in its entirety.

E. Special weight limits.

(1) Pursuant to § 349.16, Wis. Stats., the authority responsible for road maintenance in the Town of Ledgeview may impose special weight limitations on any such road or a portion thereof which, because of weakness of the roadbed, climatic conditions, or to promote the general welfare of the public, or other special or temporary condition, would likely seriously damage or destroy the road in the absence of such limitations.

(2) Pursuant to § 349.16, Wis. Stats., the authority may exempt vehicles carrying certain commodities specified by the authority or which are used to perform certain services specified by the authority from the special weight limitations which are imposed or may set different weight limitations than those imposed.

(3) Subject to the conditions and limitations set forth in § 346.16(3), Wis. Stats., any vehicle that is used to transport material pumped from a septic or holding tank shall be exempt.

F. Sign placement. Imposition of the prohibited and restricted routes and the special weight limitations shall be done by erecting signs on or along the road on which such limitations apply.

§ 118-4 Off-road motorized recreational vehicle regulations.

A. Publicly owned property. The operation of recreational off-road motor vehicles is prohibited on all publicly owned property in the Town of Ledgeview.

Any person violating any provisions of this article shall be subject to a forfeiture and penalty as provided by Chs. 343 and 346, Wis. Stats.
