A.
Disorderly
conduct, as defined in the Pennsylvania Crimes Code of 1972 (18 Pa.
C.S.A. § 5503), and as hereinafter set forth is hereby prohibited
within the Township of Unity.
B.
A
person is guilty of disorderly conduct if, with intent to cause public
inconvenience, annoyance or alarm, or recklessly creating a risk thereof,
he:
(1)
Engages in fighting or in threatening, violent or
tumultuous behavior; or
(2)
Makes unreasonable noise; or
(3)
Uses obscene language, or makes an obscene gesture;
or
(4)
Creates a hazardous or physically offensive condition
by any act which serves no legitimate purpose of the actor; or
(5)
Loiters, loafs, or congregates upon any public street,
alley, right-of-way, sidewalk or other public park grounds where said
conduct is an annoyance to other residents in close proximity thereto,
nearby, therein or thereabout or who may be traversing upon or near
the places where said activity is occurring or is a threat to the
traveling public or is an interference with the free and full passage
of pedestrians or vehicles.
C.
As
used in this section, the word "public" means affecting or likely
to affect a person in a place to which the public or a substantial
group has access. Among the places included are streets, alleys and
sidewalks, bridges, the structural parts of bridges (whether intended
to be accessible or not accessible), dams, causeways, transport facilities,
schools, prisons, apartment houses, places of business or amusement,
any neighborhood, or any premises which are open to the public.
A.
Any
person violating any provision of this chapter shall, upon conviction
thereof by the District Justice in a summary criminal proceeding,
be punishable by a fine of not more than $1,000, together with the
costs of prosecution and reasonable attorneys' fees, or in default
of payment thereof, by imprisonment for not more than 30 days. Each
day's violation shall constitute a separate enforceable offense.
B.
Notwithstanding
the foregoing penalty, Unity Township may, if it deems it appropriate,
proceed in an action in equity to cause an injunction to issue, either
preliminarily or otherwise, or to have a court of competent jurisdiction
issue a restraining order against any person or other entity from
a violation or violations of the within chapter.
