[Adopted 2-2-1993 by Ord. No. 3-93 (Ch. 68, Art. I, of the 1974 Code)]
Pursuant to Section 11 of the Uniform Fire Safety Act [P.L. 1983, c. 383, § 11 (N.J.S.A. 52:27D-202)], the New Jersey Uniform Fire Code shall be locally enforced within the City of Northfield.
The local enforcing agency shall be the Bureau of Fire Prevention and Inspection, which is hereby created in the Northfield Fire Department.
A. 
The local enforcing agency shall enforce the Uniform Fire Safety Act (N.J.S.A. 53-27D-192 et seq.) and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the City of Northfield, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
B. 
Notwithstanding anything to the contrary contained herein, the Department of Community Affairs shall continue to be responsible to inspect all buildings, structures and premises owned or operated by the state, its agencies, departments or instrumentalities or an interstate agency.
The local enforcing agency established by § 171-12 of this article shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by § 171-12 of this article shall be a part of the Northfield Fire Department and shall be under the direct supervision and control of the Fire Chief.

The Fire Official and any other employees as may be necessary within the local enforcing agency shall be appointed by the governing body of the City of Northfield upon the recommendation of the Chief of the Northfield Fire Department.
B. 
The local enforcing agency designated in § 171-12 of this article shall be under the direct supervision of a Fire Official.
C. 
The Fire Official, with the approval of the Fire Chief of the Northfield Fire Department, shall appoint a member(s) of the Fire Prevention Bureau and/or a member of the Northfield Fire Department as the Fire Investigator(s).
D. 
The Fire Investigator(s) will investigate every fire and/or explosion occurring within the City of Northfield as per N.J.A.C. 5:18A-3.3(a)25.[1]

The Fire Official shall serve for a term of one year and until his successor has been duly appointed and qualified. Any vacancy shall be filled for the unexpired term.
The Fire Official and any other employee of the enforcing agency shall be subject to removal by the Fire Chief of the Fire Department of the City of Northfield for inefficiency, misconduct or failure to properly and adequately enforce the Uniform Fire Safety Act (N.J.S.A. 52-27D-192 et seq.) or for other good cause shown. Any employee terminated shall be given an opportunity to be heard before a hearing officer or a panel of hearing officers designated or appointed by the governing body of the City of Northfield.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-306), any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Atlantic County.
The inspections and the fees required pursuant to the Uniform Fire Safety Act (N.J.S.A. 52:27D-192 et seq.) and the regulations of the Department of Community Affairs shall apply.

In addition to the registration and inspections of life hazard uses as required by the Uniform Fire Safety Act (N.J.S.A. 52:27D-192 et seq.), the permit fee for each permit type shall be established by the Uniform Fire Code.
B. 
In addition, any application fee required by the enforcing agency and not otherwise classified in this section or the preceding section of this article shall be $40.

Nothing contained within this article is intended to permit any activity or any use not otherwise authorized or permitted pursuant to the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.) and Chapter 215, Land Use and Development, of the Code of the City of Northfield.
