A public library shall be established for the City of Cohoes, to be
known as the "Cohoes Public Library," and money shall be appropriated by tax
or otherwise to equip or maintain such library, and a building or room shall
be provided for its use.
The City of Cohoes may acquire real or personal property for library
purposes by gift, grant, devise, bequest or condemnation and may take, buy,
sell, hold and transfer either real or personal property for public library
purposes.

The Mayor of the City of Cohoes shall appoint a Board of Trustees, to
consist of nine members, said appointments to be confirmed by the Common Council.
Within one month from taking office, the Trustees shall apply to the
Regents for a Charter.
The Board of Trustees shall manage and control such library and shall
have all the powers of trustees of other educational institutions in the University
as set forth in § 226 of the Education Law of the State of New York.
Such Board shall elect a President, Secretary and Treasurer. Before entering
upon his duties, such Treasurer shall execute and file with the Trustees an
official undertaking in such sum and with such sureties as the Board shall
direct and approve. The Treasurer need not be a member of the Board. The funds
of the library shall be deposited in a bank or banks designated by the Board
of Trustees and shall be expanded only under the direction of such Trustees
upon properly authenticated vouchers.

The term of office of all trustees is shall be five years, except that
the terms of the newly appointed members shall expire on December 31, 1981,
and December 31, 1982, and the terms of office of their successors shall be
full five-year terms. Thereafter, the successors of each Trustee shall be
elected annually.
No member of the Common Council shall be eligible for the office of
such Public Library Trustee.
The Cohoes Public Library shall be forever free to the inhabitants of
the City of Cohoes, subject always to rules of the Library Trustees, who shall
have the authority to exclude any person who willfully violates such rule;
and the Trustees may, under such conditions as they think expedient, extend
the privileges of the library to persons living outside such municipality.
