Any public entity within the City of Cohoes, that is subject to the New York State Civil Service Law, may make application to the Chief of Police for the fingerprinting and background check for criminal convictions of any potential watchman, as that title appears in Title 4, Appendix 3 of the New York State Code of Rules and Regulations, being considered for hire by their entity.
The entity applying for such a background check shall pay with its application any and all fees and expenses currently charged by the New York State Division of Criminal Justice Services, together with an administrative fee of $35 that shall be paid into the general fund of the City.
The entity applying for such a background check shall provide the name and title of the appointing authority charged with receiving the Chiefs report as to whether the potential watchman qualifies under the entity's criteria, the job description and qualifications adopted by the City of Cohoes Municipal Civil Service Commission, and pursuant to law. Said appointing authority shall provide the Chief of Police with the entity's criteria for qualification for the watchman position with regard to criminal convictions. The Chief shall receive from the City of Cohoes Municipal Civil Service Commission the job description and qualifications of the watchman position with regard to criminal convictions.
Each potential watchman who chooses to undergo the background check shall have impressions of the fingers of both hands made under the supervision of the Chief of Police. All fingerprints and processing fees, other than the City's administrative fee, shall be submitted to the New York State Division of Criminal Justice Services. The Chief of Police shall enter into any necessary agreement with the New York State Division of Criminal Justice Services, upon approval of the Corporation Counsel, to effectuate this article.
Only the Chief of Police, or his designee, shall be authorized to receive and review a criminal history from the New York State Division of Criminal Justice Services. The Chief will prepare a report for the entity applying for such a background check; said report shall only be the Chiefs finding of whether the potential watchman is qualified under the entity's criteria, qualifications adopted by the City of Cohoes Municipal Civil Service Commission, and pursuant to law. Articles 23 and 23-A of the New York State Correction Law shall be considered by the Chief when making his finding of qualification. The fingerprints and criminal history provided for in this article are for the purposes of this article only and shall not be filed in the files relating to criminal identification.
