A.
Any person owning, keeping, possessing or harboring any dog or cat
shall promptly remove and dispose of all feces or excrement left by
the dog or cat on any public property and on any private property
not owned by such person or the lawful residence of such person. Any
person walking or exercising a dog on any public property, including
a park, sidewalk, or City right-of-way, or on any private property
not owned by such person or the lawful residence of such person shall
carry with him/her at all times and be able to produce upon lawful
inspection a bag or container suitable for removing and disposal of
said feces or excrement. This section shall not apply to those persons
legally blind and whose dog is considered a guide dog.
B.
Any person owning, keeping, possessing or harboring any dog or cat
shall maintain their own premises or property in a clean, safe and
sanitary condition. That a premises shall be in a clean, safe and
sanitary condition shall be the responsibility of both the property
owner, even if not a resident, and the resident pet owner, even if
not the owner of the property.
Any person, firm or corporation violating any provision of this
article shall be fined not more than $500 for each offense.
Every Animal Control Officer shall have the power to issue an
appearance ticket pursuant to § 150.20 of the Criminal Procedure
Law, to serve a summons and to serve and execute any other order or
process in the execution of the provisions of this article. In addition,
any Animal/Dog Control Officer, any peace officer, or any Code Enforcement
Officer when acting pursuant to his/her special duties, or police
officer who is authorized by a municipality to assist in the enforcement
of this article may serve any process, including an appearance ticket,
a uniform appearance ticket and a uniform appearance ticket and simplified
information, related to any proceeding, whether criminal or civil
in nature, undertaken in accord with the provisions of this article.
