There shall be a municipal skate park, owned and operated by the City of Cohoes, located in Lansing Park.
The skate park shall be opened seasonally as weather permits. Hours of operation shall be clearly posted, and the park shall be locked at all times when not opened for use. No trespassing shall be allowed in the park when not opened for use. Generally, during those times when schools are in session, the hours of operation shall be 3:00 p.m. to dusk. During summer months and other times when schools are not in session such as weekends and vacations, the hours of operation shall be 12:00 noon to dusk. The Human Services Director shall post in City Hall and at the park itself the hours of operation and may alter them as need be.
No person shall be permitted to use the municipal skate park without first acquiring a duly issued badge from the Human Services Director. Skate park badges shall be nontransferable and nonassignable. Only those persons 10 years of age and older may be issued a badge. Badges must be shown to enter the park, kept on each skater's person, and available for inspection at all times while using the park. The Human Services Director shall promulgate appropriate application for badges and waiver of liability, which must be filled out and signed by each applicant and by his or her parent or legal guardian if a minor. Only residents of the City of Cohoes, or children of residents, or nonresident taxpayers, may be issued a municipal skate park badge.
The fee for a one-day municipal skate park badge shall be $2. The fee for a season badge (good during that calendar year) shall be $25, or $50 for a family. "Family" shall mean immediate family.
The following rules shall be given to each skater upon application for a badge and shall be posted at the municipal skate park.
A. 
All skaters must skate safely and responsibly. No skater may enter the skate park when it is already being used to capacity. When skaters are waiting to enter, a time limit of 20 minutes per person shall be imposed.
B. 
All skaters must wear the following safety equipment at all times: helmet with safety strap, elbow and knee pads. Those using skateboards must wear shoes (no barefeet or sandals).
C. 
No non-skaters may enter the park unless accompanying a child.
D. 
The skate park is for in-line skates and skateboards only. No other use is permitted in or on the skate park whatsoever.
E. 
Use of profanity or abusive language is prohibited and shall result in a violation of this chapter and appropriate penalties are set forth herein.
F. 
Skating will not be permitted when surfaces are wet or icy.
G. 
No alcohol shall be permitted in the skate park. No glass containers or food or drink is permitted in the skate park.
H. 
No loud music shall be permitted at the skate park.
The Board of Managers, upon the recommendation of the Human Services Director, may promulgate additional rules for the use and control of the municipal skate park. Such rules shall be given to each skater upon application for a badge and shall be posted at the municipal skate park.
Any person violating or failing to comply with the provisions of this chapter, or any rules established pursuant hereto, may be immediately ejected from the skate park. Multiple or serious violations shall result in permanent forfeiture of the privilege to use the skate park. In addition, any violations of other provisions of the City Code or state law will result in appropriate action by law enforcement and prosecution.
