§ 570-7Violations and penalties.
As used in this chapter, the following terms shall have the meanings indicated:
- BUREAU OF WEIGHTS AND MEASURES
- The Bureau of Weights and Measures established within the Department
of Human Services.[Amended 8-13-1981 by Ord. No. MC-1766]
- WEIGHTS AND MEASURES
- Any weight, measure, scale beam, patent balance, spring scale, streetyard, tape, counter measure, receptacle of any kind or any other instrument or apparatus and accessories connected therewith used in weighing or measuring any commodity, fluid or article of merchandise.
No person shall use any weight or measure, as defined in § 570-1, in weighing or measuring any commodity, fluid or article of merchandise intended to be sold without first having such weight or measure registered with the Bureau of Weights and Measures in accordance with the provisions of this chapter.
Any person registering any weight or measure shall furnish to the Bureau of Weights and Measures the following information in writing:
The name and address of the owner.
The location of the premises where the weight or measure is to be used and, if to be used on a vehicle, the location of the premises wherein the vehicle is stored.
The number, type and kind of weights and measures to be used in such premises or on such vehicle.
The character of the business conducted in such premises or on such vehicle.
Any person registering any weights or measures with the Bureau of Weights and Measures shall obtain from said Bureau a registration card, which shall be prominently displayed in a conspicuous place in the premises or on the vehicle where the registered weight or measure is used.
No fee shall be charged for registering any weight or measure.
Nothing contained in this chapter shall be deemed to supersede any rule or regulation promulgated by the Division of Weights and Measures in the State Department of Law and Public Safety.
