There is hereby established a Board of Municipal
Swimming Pool Commissioners to consist of five regular members of
the Borough of Paramus and two alternate members, all of whom shall
be residents of the Borough of Paramus.

The Mayor shall nominate and by and with the
advice and consent of the Council shall appoint all regular and alternate
members of said Board of Municipal Swimming Pool Commissioners in
the manner provided by law for the appointment of Borough officials.

All regular and alternate members of the Paramus
Municipal Swimming Pool Commission hereafter appointed shall be appointed
for periods of three years and each appointee shall serve until his/her
successor is duly appointed and qualified, except the initial term
of the alternates shall be a term to end on January 1, 2000, and a
term to end on January 1, 2001. Thereafter, subsequent appointments
shall be for a term, except where filling an unexpired term of three
years.
Vacancies occurring in the membership of the
Commission shall be filled by the Mayor with the advice and consent
of the Council. A vacancy created other than by the expiration of
the normal original term of appointment shall be filled in the manner
set forth above for the unexpired portion of the term.
The appointment of Commissioners previously made under Article 4 of Chapter 6 of the Revised Ordinances of the Borough of Paramus, 1969, shall remain effective until the end of the unexpired term of each Commissioner presently holding said position.
A.
The Board of Municipal Swimming Pool Commissioners
shall have the general supervision and control over the maintenance,
operation and regulation of the Paramus Municipal Swimming Pool except
as otherwise provided by statute or the other provisions of this chapter.
The municipal swimming pool referred to herein is located generally
south of the site of the Westbrook Junior High School in the Borough
of Paramus.
B.
Subject to the foregoing, the Board of Municipal Swimming
Pool Commissioners shall exercise general supervision and control
of all forms of recreational playground and public entertainment activities
at the Paramus Municipal Swimming Pool.
The members of such Commission shall serve without
compensation. Necessary expenses shall be allowed and paid by the
municipality out of the municipal swimming pool utility account provided.
A.
The Commission shall meet at least 12 times each year
and at least once in each calendar month of the year. Any Commissioner
who for any reason fails to attend at least 60% of such regular monthly
meetings shall be deemed to have forfeited his office, and said position
shall be deemed vacant for the unexpired term of the last appointment
of said Commissioner.
B.
The Commissioners of the Municipal Swimming Pool shall be subject in all respects to Chapter 99, Personnel Policies, except that the Commissioners shall not be subject to § 99-15C of the aforementioned chapter (regarding certain prohibitions against political activity).

A.
In January of each year the Swimming Pool Commission
shall submit a budget to the governing body for its consideration.
The governing body shall retain the power to approve or disapprove
said budget or to modify it or to remake it for each calendar year.
B.
All appropriations or costs incurred by the Municipal
Swimming Pool Commission shall be in accord with the annual budget
adopted by the municipality and any salary ordinance controlling the
salaries of Borough employees who are employed by the Municipal Swimming
Pool Commission.
By resolution adopted at a public hearing, the
governing body shall establish fees, rents or other charges for each
calendar year for the use and enjoyment of the municipal swimming
pool or any of its facilities, with the objective of providing sufficient
fees, charges and income so that the municipal swimming pool's total
revenue is sufficient to defray its total cost on an annual basis.
A.
All purchasing of supplies, equipment, construction
work and services (other than employees' services) shall be bid as
required by statute and processed through Borough procurement policies.
B.
The estimated cost of services or material furnished
by Borough departments or Borough employees to the Municipal Swimming
Pool Utility shall be charged to the Municipal Swimming Pool Utility
account and charged against its budget so that the total cost of the
swimming pool utility to the Borough can be determined in accordance
with standard municipal accounting procedures consistently applied.
All financial records of the Municipal Swimming
Pool Commission shall be kept and preserved permanently and in accordance
with law and standard municipal accounting practices consistently
applied. Such records shall be deemed public records and shall be
open to public inspection during reasonable business hours.
A.
The Municipal Swimming Pool Commissioners shall have
the power to hire and fire the pool manager, who shall serve for the
pool season.
B.
Upon the recommendation of the pool manager, the Municipal
Swimming Pool Commissioners shall have the power to hire and fire
all employees of the Municipal Swimming Pool Utility, other than the
Executive Secretary.
C.
None of the employees of the Municipal Swimming Pool Utility, except the Executive Secretary, shall be subject to Chapter 5, Administrator, Municipal (regarding appointment and removal by Mayor and Council and Borough Administrator in certain instances).

D.
All employees hired by the Municipal Swimming Pool Commissioners shall be subject to Chapter 99, Personnel Policies, except as otherwise specifically provided herein.

E.
Nothing herein shall be deemed to in any way impair
or change the status or eligibility of the Executive Secretary with
respect to insurance, pension or any other right heretofore or hereafter
vested in such person as a Borough employee.

The pool season shall not be less than the period
of time from the date of opening of the pool to the date of closing
of the pool, which period shall be from the last Saturday in May of
each year to and including two days after Labor Day in September of
each year.
A.
Chapter 5, Administrator, Municipal (establishing the office of Municipal Administrator and stating the duties of said officer), is hereby amended, but only to the extent set forth in this chapter, and in all other respects shall remain in full force and effect.

Subsection 7.A.19 of Ordinance No. 72-9 is hereby
amended and supplemented to the extent that the same is or may be
inconsistent herewith.
