This article is enacted to establish rules and regulations for
the protection, care and control of the public parks, playgrounds,
band shell and Sports-Plex in the Borough and owned, leased or under
the jurisdiction of the Borough and to regulate the conduct of persons
on or within such parks and playgrounds or using the facilities thereof.
The "Sports-Plex" is defined as the new lighted sports complex spread
over eight acres of land located near the Garden State Plaza (Paramus
Road/Plaza Way). The complex consists of a football, soccer, softball,
little league and major league fields as well as basketball courts,
boccie courts, walking paths and a kiddie playground. There is also
a building constructed in the center to house the bathrooms, storage
area and a kitchen.

The official name of the Sports-Plex as described in § 323-1 shall be the "Cliff Gennarelli Paramus Sports-Plex."
Except for unforeseen emergencies and officially sanctioned,
authorized and supervised Borough events and activities permitted
in writing by the Director of Recreation with the approval of the
Recreation Commission, the public parks, playgrounds and band shell
shall be closed from sunset until sunrise. The provisions of this
section shall also apply to any adjacent parking lot areas. The operating
hours of the Sports-Plex will be determined by the programs scheduled
by the Paramus Recreation Commission; however, in any event, the Sports-Plex
will be closed at 11:00 p.m.
No person shall:
A.
Fly a remote-controlled model airplane in any park, playground or
band shell when an activity is in progress. No bikes, skateboards,
rollerblades and scooters are permitted at the Sports-Plex.
B.
Play golf in any park, playground, band shell and the Sports-Plex.
C.
Except an authorized employee of the Parks and Recreation Commission,
drive any motor vehicle or motorized vehicle, including snowmobiles,
upon fields, paths, driveways or roadways within any park, playground,
band shell or the Sports-Plex.
No domestic animal or fowl shall be allowed on or within a park, playground, band shell or the Sports-Plex or adjacent parking areas. Any person who takes an animal into a park, playground, band shell or the Sports-Plex shall be subject to the provisions of Chapter 169, Animals, Part 1, Dogs, of this Code, as amended and supplemented.
No person shall drop, place or throw any paper or other refuse
anywhere except in a receptacle provided for refuse.
No person shall erect or occupy any tent, stand or other structure
in any park, playground, band shell or the Sports-Plex or sell or
give away from any such tent, stand or other structure any food, drink
or other items without the written permission of the Recreation Commission.
No person shall make any fire within a park, playground, band
shell or the Sports-Plex except at such places and under such conditions
and restrictions as may be prescribed by the Recreation Commission.

No person, on or within a park, playground, band shell or the
Sports-Plex, shall:
A.
Sell, expose for sale or give away goods, wares or circulars, or
post or display any sign, placard or advertising device, without written
permission by the Recreation Commission.
B.
Play, engage in or take part in any game or competitive sport for
money or other valuable things without written permission of the Recreation
Commission.
C.
Solicit alms or contributions for any purpose without the written
permission of the Recreation Commission.
D.
As part of a group, make any harangue or move in a military or civic
parade, drill or procession without written permission of the Recreation
Commission; nor shall any individual interfere with another's
enjoyment of the facilities of the parks, playgrounds, band shell
or the Sports-Plex.
E.
Engage in any form of smoking, including, but not limited to, cigarettes,
cigars, e-cigarettes, or "vapes."
No person on or within a park, playground, band shell or the
Sports-Plex shall sell, serve, deliver, consume, possess, expose for
sale or give away any alcoholic beverage.
A.
A person or group seeking issuance of a permit hereunder shall file
an application with the Recreation Commission. The application shall
state:
(1)
The name and address of the applicant.
(2)
The name and address of the person, persons, corporation or association
sponsoring the activity, if any.
(3)
The day and hours for which the permit is desired.
(4)
The park or portion thereof for which such permit is desired.
(5)
An estimate of the anticipated attendance.
(6)
Any other information which the Recreation Commission shall find
reasonably necessary to a fair determination as to whether a permit
shall be issued.
(7)
That the applicant possesses the insurance required by the Recreation
Commission.
B.
Any organized Borough-sanctioned event is required to have a permit
from the Recreation Commission.
A.
The Director of Recreation and recreation attendants, police officers,
playground directors, park rangers, park superintendent, park foremen
or other persons designated by the Recreation Commission shall diligently
enforce the provisions of this article.
