The provisions of this article are hereby established for the
purpose of regulating the use and operation of the Borough swimming
pool facilities.
As used in this article, the following terms shall have the
meanings indicated:
The individual's age as of May 15 of each year.

The total area belonging to the swimming pool facility.
The first ten-foot area of concrete immediately surrounding
the pools.
The entire fenced area surrounding the pools and the bathhouse.
The Paramus Board of Municipal Swimming Pool Commissioners.
The remainder of the concrete area surrounding the pools
beyond the pool apron areas.

A.
Pursuant to and in accordance with the Public Health and Sanitation
Codes Adoption by Reference Act (N.J.S.A. 26:3-69.1 to 26:3-69.6),
there is hereby established and adopted the whole of that certain
printed code known as "New Jersey State Sanitary Code, Chapter IX,
Public Recreational Bathing, N.J.A.C. 8:26-1 et seq., January 1987,"
approved by the State Department of Health, January 1987.
B.
The New Jersey State Sanitary Code, Chapter IX, Public Recreational
Bathing, N.J.A.C. 8:26-1 et seq., January 1987, is hereby incorporated
in this article by reference and made a part hereof as fully as though
it had been set forth at length herein.
C.
In accordance with law, three printed copies of the New Jersey State
Sanitary Code, Chapter IX, Public Recreational Bathing, N.J.A.C. 8:26-1
et seq., January 1987, have been placed on file in the office of the
Borough Clerk and in the office of the Health Officer of the Borough
and shall remain on file in said offices for the use and examination
of the public as long as this article shall remain in effect.

A.
Residence requirements. Membership is limited to permanent residents
of the Borough of Paramus who have paid the required fees. Out-of-town
memberships will be offered at the discretion of the Pool Commission.
B.
Types of memberships:
(1)
Family membership shall include any of the following who reside in
the same household: husband; wife; civil union partner; unmarried
children; legal guardian children.
(2)
Individual membership shall be available to any permanent resident
of the Borough over 16 years of age.
(3)
Senior citizen membership shall be available to permanent residents
of the Borough 62 years of age or older.
C.
Memberships not transferable. All memberships issued for the use
of the swimming pool facilities are not transferable.
D.
Guests. Each family membership shall be offered for purchase a number
of guest passes listed in the current pool rules.
E.
Membership fee refund. Membership fees are not refundable.

B.
Residents of the Borough who are members of the Armed Forces of the
United States on active duty and who are otherwise eligible to use
the facilities shall be allowed to swim at no charge; provided, however,
that they present evidence to the swimming pool office that they are
on leave.
C.
Badges. All identification badges must be kept year to year. Service
charge of $30 for replacement of an I.D. badge.
D.
In addition to full season membership in the Paramus Pool, the nonrefundable
fee for the registration to join the swim/dive lessons shall be $100
per person per course.
E.
In addition to full season membership in the Paramus Pool, the nonrefundable
fee for the registration to join the swim/dive team shall be $75.
Swim/Dive Team Parent Association dues and swimsuits are an additional
fee.

A.
All members will be issued identification badges which must be shown
for admission to the facility and shown upon request by authorized
pool personnel.
B.
Identification badges or cards are not transferable.
C.
Illegal transfer of badges or cards or the giving of false information
or defacing of identification badges or cards will result in revocation
or suspension of membership.
D.
Lost identification badges must be reported to the pool manager immediately
and can be replaced by a temporary identification badge, good for
one week only. At the end of one week, a new identification badge
will be issued at the cost of $30 and the temporary badge will be
returned to the pool office.

Current pool rules are on file in the Borough Clerk's office
and are also available at the pool office.
A.
All bathers, including babies, must wear bathing suits in both the
swimming and wading pools. Babies in diapers are not allowed in the
main pool unless the intermediate pool is closed. All babies in diapers
must have rubber or plastic pants on.

B.
Anyone with shoulder length hair shall be required to wear a bathing
cap at all times in the pool.

C.
Any person having a communicable disease, open blisters or cuts,
sore or inflamed eyes, ears, nose or mouth infections, excessive sunburn
or any type of skin disease will be excluded from the pool area. No
person wearing any type of bandage, cast or Band-Aid shall be permitted
in the pool.
D.
No inflatable water paraphernalia shall be allowed within the pool
area. Snorkels, fins, masks or other swimming aids shall be permitted
only by special permission.

E.
Diving will be permitted in designated areas only.
F.
No one shall be allowed in the water unless a lifeguard is present.
G.
No swimming will be permitted in diving areas, except by divers.
H.
During adult swim only, one hand-held infant may be taken into the
intermediate pool only.

A.
All vehicles shall be parked in areas designated for that purpose.
Vehicles illegally parked will be ticketed by the Paramus Police Department.

B.
Street clothing shall be left in areas designated for that purpose.

C.
No person shall comb his hair within the pool apron area. Women and
girls of any age shall not wear curlers within the pool apron area.
D.
Dressing and undressing shall be permitted only in locker rooms and
shall not be permitted in the parking areas.
E.
All food shall be served and consumed within designated areas only.
Under no circumstances shall food or beverages be brought into the
pool area.
F.
Children under 13 years of age shall not be permitted unless accompanied
by a responsible member 16 years of age or older. This member must
remain with the child at the pool and be responsible for the supervision
of the child while in the water and at any other pool area.

G.
Destruction or defacing of property will result in suspension or
revocation of membership and expulsion from the area. The Pool Commission
will bring suit to recover damages resulting therefrom.

H.
The pool management will not be responsible for valuables brought
into the area.
I.
All litter, paper or debris shall be placed in designated trash receptacles.
J.
Card tables and umbrellas shall be permitted in designated areas
only.
K.
Dress in and out of the pool shall be consistent with standards of
good taste. Extremely brief-type swimming attire is not considered
suitable or in good taste.[1]

In addition to any other conduct which may be determined by
the pool officials to be inimical to the safe and orderly operation
of the pool, the following activities are expressly prohibited:
A.
The use of glass, glass containers or metal containers within the
pool area. If a person is caught bringing in glass a second time,
this will result in an immediate one-week suspension from the pool.
Further violations of this imposed rule can lead to revocation of
pool membership.

B.
Possession, display or consumption of alcoholic beverages within
the area.
C.
The operation of bicycles within the pool area.

D.
The operation of portable radios, television sets or record players
with the use of earphones only is permitted.

E.
Bringing pet dogs, cats or any other animals within the area.
F.
Ball playing, roughhousing, wrestling, rowdiness or other similar
conduct affecting the safety and comfort of others within the area.
G.
Any other conduct which, in the opinion of the pool manager, is detrimental
to the safe and healthful operation of the pool.

H.
Distribution of any type of literature.

I.
Parents should be aware that health rules and Commission rules prohibit
urinating on the pool grounds. Such acts will result in immediate
suspension.

All pipe and cigar smoking is prohibited on pool grounds.

K.
All smoking, including cigarette smoking, is prohibited in the playground
area, the snack bar, the pool deck, the gazebo and in all buildings.

A.
Regulations shall be posted at the pool and strictly enforced.
B.
The Pool Commissioners, pool manager or the assistant manager may
close or limit the swimming pool facilities whenever, in their judgment,
such action is deemed necessary or desirable for the protection of
health or safety of such persons entitled to use such facilities.
C.
Members of the Police Department of the Borough, designated agents
of the Borough, Pool Commissioners, the pool manager, and the assistant
manager and all lifeguards when on duty at the swimming pool facilities
shall have authority to prohibit any action or conduct which they
may consider to be dangerous, improper or immoral or any act or actions
in violations of rules and regulations hereinbefore provided and shall
have the power of expulsion or suspension of the privileges otherwise
granted to the holder of a membership badge or card.
D.
All memberships are granted subject to the rules and regulations
as established by the Pool Commissioners or by ordinance or resolution.
Failure to abide by these rules and regulations may result in revocation
or suspension of membership.
E.
Any person violating any of the provisions of this article may have
his membership suspended by any of the stated enforcement authorities.

Any person who violates any provision of this article shall, upon conviction, be subject to the penalties provided by § 1-15 of this Code.

As used in this article, the following terms shall have the
meanings indicated:
Includes all public swimming pools, bathing beaches, health
spas and whirlpool baths and bathing establishments where bathing
and swimming are allowed, whether in artificial pools or lakes or
watercourses of the Borough of Paramus and which are maintained or
operated for the purpose of profit or which may be an accessory use
of any hotel, motel or lodging facility. This shall be construed to
include apparatus, equipment and premises upon which any swimming
pool, bathing beach or bathing establishment is located or the premises
appurtenant thereto. The term "bathing establishment" shall hereinafter
be used in this article to include all swimming pools, bathing beaches
and bathing establishments as aforesaid but does not include private
swimming pools ancillary to residential use.
It shall be unlawful for any person, partnership, association,
corporation or agent and employee, either for himself or for another,
to engage in the operation of or to establish, construct or maintain
any swimming pool, bathing beach or bathing establishment or public
bath for profit in the Borough of Paramus without first having obtained
a permit in the manner hereinafter provided.

Applications for purposes set forth in § 395-15 hereto shall be made to the Board of Health who shall, after compliance with the following rules and regulations, issue a license, in writing, upon payment of a license fee, and which license shall not be transferable without the prior consent of the Mayor and Council. The fees to be levied are as follows:
A.
For the issuance of a permit to operate a year-round indoor public
or semipublic swimming pool and/or whirlpool: $300.
B.
For the issuance of a permit to operate a seasonal outdoor public
or semipublic swimming pool: $200.
C.
For the issuance of a permit to operate an outdoor public or semipublic
bathing place: $200.
D.
Plan review fee for a public recreational bathing facility: $75.
No person, partnership, association, corporation or agent and
employee, either for himself or for another, shall establish, construct,
operate or maintain any bathing establishment without a permit or
license issued subject to the conditions as imposed by this article.
Any permit or license may be suspended for cause by the Mayor and
Council after a public hearing with five days' notice to the operator
of said swimming establishment or upon the recommendation of the Local
Health Officer or the State Board of Health resulting from violations
of the Health Code.
Every bathing establishment shall be so designed and constructed
and shall be so maintained and operated so as to be clean and sanitary
at all times and shall be provided with all necessary safety equipment
as required by the Board of Health.
In artificial pools, the inlets for fresh and purified water
and outlets shall be so located and spaced as to secure a maximum
of dispersion of the inflowing water to the pool.
Adequate and proper toilet facilities, conveniently located
for use immediately before entering the pool, lake or watercourse,
shall be provided at all bathing establishments, and adequate shower
facilities shall also be provided.
The Board of Health of the Borough of Paramus or its duly authorized
agents have the right of access to any bathing establishment at all
times for the purpose of taking samples of water and making a complete
inspection of the premises.
In the event that any apparatus used for the purpose of disinfecting
swimming pool water or purifying the same shall become incapacitated
and repairs are not made within the period of four hours, the Board
of Health shall be immediately notified, and the Board of Health shall
then determine as to the future operation of the swimming pool until
the necessary repairs are made.
The water in any swimming pool, bathing establishment or lake
or watercourse used for swimming or bathing purposes in connection
with any public bathing establishment must be subject to tests by
the Local and State Boards of Health as to purity and safety for bathing
purposes.
Every bathing establishment shall be under the supervision of
a competent attendant, who shall require a careful observance of sanitary
regulations and who is or has as a member of his staff a person capable
of administering first aid. A swimming instructor, lifeguard or other
person trained in methods of lifesaving and artificial resuscitation
must be on duty at all times when the pool is open to bathers, and
suitable lifesaving equipment must be provided and be readily accessible
at all pools.
A.
No person showing evidence of sore or inflamed eyes, mouth, nose
or ear discharges or skin eruptions shall use any swimming pool, lake
or watercourse used as a bathing establishment, and no intoxicated
person shall be permitted to use any swimming pool, lake or watercourse
used as a bathing establishment.
B.
The Local Board of Health and the State Board of Health reserve the
right to close any and all bathing establishments without notice when
they have reason to believe any epidemic or disease may be transmitted
through the use of bathing establishments or because of continued
failure to meet the standards as set forth in this article.

Any person who violates any provision of this article shall, upon conviction, be subject to the penalties provided by § 1-15 of this Code.
