A City Clerk shall be appointed by the Council, pursuant to the charter, for the term provided by law. Prior to his appointment, the Clerk shall be qualified by training or experience, or a combination thereof, for the duties of his office.
The Clerk shall:
A. 
Serve as Clerk of the Council, keep its minutes and records of its proceedings, maintain and compile its ordinances and resolutions as required by the charter, general laws and ordinances.
B. 
Provide secretarial and clerical services for the Councilmen in the discharge of their official duties.
C. 
Have custody of the City's Seal and affix it to such books, papers and documents as may be authorized pursuant to law.
D. 
Have and take custody of all official books, papers and documents of the City for which no other repository is provided by charter or ordinance and preserve and keep them safely.
E. 
Perform all of the functions relating to elections required of a Municipal Clerk by the General Election Law (Title 19 of the Revised Statutes) and by the Optional Municipal Charter Law.[1]

F. 
Have such other, different and additional powers, functions and duties as may be prescribed by law or ordinance.
The Council may appoint a Deputy Clerk who shall perform the functions, powers and duties of a City Clerk in the absence or upon the direction of the latter and who shall perform such other functions, powers and duties as may be required by or pursuant to law or ordinance.
A. 
The City Clerk shall also issue Certificates as to Liability for Assessment for Municipal Improvements in accordance with the provisions of N.J.S.A. 54:5-18.1 et seq.
B. 
Prior to the issuance of any such certificate, he shall secure from the City Engineer his countersignature which shall indicate that, to the best of his knowledge, information and belief, the certificate is correct.
The City Clerk shall administer such licensing functions as are vested in the City Clerk by state law or ordinance.
The City Clerk, subject to the supervision of the Business Administrator, shall:
A. 
Be the depository and custodian of:
(1) 
All official surety bonds furnished by or on account of any officer or employee, except his own bond, which shall be placed in the custody of the Comptroller.
(2) 
All insurance policies upon or with respect to risks insured for the benefit of the City or to protect it against any claim, demand or liability whatsoever.
(3) 
All formal contracts for work, labor, services, supplies, equipment and materials to which the City may be a party.
(4) 
All performance bonds running to the City as obligee or any other form of security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the City.
B. 
Have custody of all leases on property owned by the City.
The City Clerk shall report to the Business Administrator annually, at such time as the Administrator may require, on the coverage, expiration date and premium of each surety bond and contract of insurance, the nature and terms of outstanding leases, the rent reserved by each and their respective expiration dates.
A. 
The City Clerk shall cause all the ordinances and resolutions passed by the Council to be recorded in bound books to be provided for that purpose, and each ordinance and resolution shall be signed by the presiding officer of the Council and the City Clerk. The City Clerk shall certify the proof of the due publication of such ordinance, but his omission to certify such ordinance or proof of publication thereof, as hereby directed, shall not impair or affect the validity in any respect.
B. 
The City Clerk shall prepare a copy of all ordinances or proposed ordinances which will require publication under the charter or general law and cause the same, properly attested, to be published in any newspaper legally qualified for the publication of official City advertisements and shall file in his office the requisite proofs of such publication.
C. 
In accordance with N.J.S.A. 40:69A-182, the City Clerk at the close of each year shall compile or codify all ordinances and resolutions with the advice and assistance of the Corporation Counsel. The Council may engage a firm or other agency to compile and codify the ordinances as an assistance to the City Clerk.
At the close of each year, the City Clerk shall, with the advice and assistance of the Corporation Counsel, bind, compile and codify all of the orders, rules and regulations of the Council of a permanent character which then remain in force and effect together with a proper index, which shall be known as the "Code of City Regulations." The City Clerk may arrange for the printing and sale of such code in the same manner as heretofore provided for the printing and sale of the Code of the City of Paterson.
A. 
All matters acted upon by the Council at any duly called meeting which, in the opinion of the Council, require further action shall be officially communicated by the City Clerk to the officer, employee, board, body, commission or other agency of the City for whatever action is to be taken by such officer, employee, board, body, commission or other agency.
B. 
Whatever action is taken in accordance with the direction of the Council shall then be communicated to the City Clerk, unless otherwise directed, for presentation to and information of the Council. Such action shall become a part of the agenda for the next meetings or until removed from the agenda by the Council.
