As used in this chapter, the following terms shall have the meanings
indicated:
Refers to the business of letting, renting, hiring or chartering
out any sailboat, rowboat, canoe, outboard canoe or any other boat to be used
and operated on the waters of the Passaic River or any other body of water
within the city.
No person shall engage in the business of boat rentals within the city
without having first obtained a license as hereinafter provided in this chapter.
A.
Application for a license shall be addressed to the Council and filed in the office of the Licensing Division on forms approved by the Council. The application shall be accompanied by the license fee prescribed in § 145-4 hereof.
B.
The application shall contain the following information:
(1)
The name and permanent home address of the applicant.
(2)
If the applicant has ever been convicted of a crime or
disorderly persons offense and, if so, when, what crime or offense and in
what court.
(3)
The place where the boat rental business is to be operated.
(4)
Inventory of the equipment offered for hire, rent or
charter.
A.
After the application is filed, a designated inspector
of the Licensing Division shall inspect and examine, for soundness and safety,
the boating equipment to be used in the boat rental business. After inspection,
the inspector shall file a report of his findings with the Council and notify
the applicant of the filing thereof.
B.
If the inspector has found any unsound or unsafe conditions
in the boating equipment, the license or renewal of a license shall not issue.
The applicant shall be given reasonable opportunity to repair or correct any
such reported unsound or unsafe conditions; and when the inspector verifies
the removal of these unsound or unsafe conditions, he shall report such findings
to the Council.
After the application is approved by the Council, the boat rental license
shall be issued by the Licensing Division.
No licensee or his agent shall:
Every licensee shall furnish each occupant of a rented boat with an
approved life preserver.
Any license issued under this chapter may be suspended or revoked by
the Council for good and sufficient cause after notice to the licensee and
hearing.
Any person who violates any provision of this chapter shall, upon conviction
thereof, be punished by a fine not exceeding one thousand dollars ($1,000.),
by imprisonment for a term not exceeding ninety (90) days or by a period of
community service for not more than ninety (90) days, or any combination thereof.
