No person shall engage in the business of hoisting and lowering material over any street or public thoroughfare in the City without first securing a license, granted by the Council and issued by the City Clerk, to carry on such business.
A. 
The fee for a license issued under this article shall be $5 for the yearly term of the license or any part thereof.
B. 
The term of the license issued under this article shall be for one year commencing on May 1. All such licenses shall expire on the 30th day of April of each year.
Before the issuance of any license under this article, the applicant shall produce before the City Clerk a public liability insurance policy or certificate thereof, with premium prepaid, in the amount of $5,000 for one person and $10,000 for one accident, to indemnify any person injured by the licensee or his agent conducting such licensed business while on any public thoroughfare in the City. Such insurance policy or certificate thereof shall be filed with the City Clerk. The licensee shall, during the term of the license, maintain said policy in full force and effect.
When the Council has granted the license, the City Clerk shall, upon receipt of the annual fee, issue the license and one metal plate bearing the license number and the expiration date thereof. The plate shall be affixed in a conspicuous part of any vehicle used by the licensee in the conduct of the licensed business. The charge for additional metal plates shall be $2 each.

Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $1,000, by imprisonment for a term not exceeding 90 days or by a period of community service for not more than 90 days, or any combination thereof. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
