A. 
It shall be unlawful for any dog to run at large except when used for hunting. The owner or keeper of any dog found running at large shall be subject to the following penalties:

(1) 
For a first offense, said owner must pay $25 cost reimbursement for the return of his or her dog.
(2) 
For the second offense, said owner must pay $25 cost reimbursement for the return of his or her dog.
B. 
Said penalties shall be collected by the Dog Constable who shall account for each payment and turn it over to the Town of Boothbay Harbor on a weekly basis.
C. 
For the third and any subsequent offense, the Dog Constable or other law enforcement officer having jurisdiction in the Town of Boothbay Harbor may bring suit against the owner of any dog running at large, and that owner commits a civil violation for which a forfeiture of not less than $100 nor more than $200 shall be adjudged.

As used in this article, the following terms shall have the meanings indicated:
AT LARGE
Off the premises of the owner and not under the control of any person by means of personal presence and attention as will reasonably control the conduct of such dog.
OWNER
Any person or persons, firm, association or corporation owning, keeping or harboring a dog.
This article is adopted under the authority of 7 M.R.S.A. § 3450.

It is a violation of this article for any person who owns, possesses or controls a dog or other animal(s) to fail to properly remove and dispose of any feces left by his or her animal on any street, sidewalk or publicly owned property.

Any person, firm or corporation who or which shall violate any of the provisions of this article shall he subject to a penalty as set forth in Chapter 1, General Provisions, Article II, General Penalty, of this Code.

No person shall keep in the town any dog which, by barking or howling or in any other manner, disturbs the peace or quiet of any neighborhood.

Any person, firm or corporation who or which shall violate any of the provisions of this article shall be subject to a penalty as set forth in Chapter 1, General Provisions, Article II, General Penalty, of this Code.
