[HISTORY: Adopted by the Borough Council
of the Borough of Mountain Lakes 6-23-1980 as Ch. VII of the 1980

As used in this chapter, words and phrases concerning
traffic shall have the meanings ascribed to them in N.J.S.A. 39:1.1.
Whenever certain hours are named in this chapter,
they shall mean either Eastern standard time or Eastern daylight saving
time, as may be in current use in the Borough.
A.
Regulations not exclusive. The provisions of this
chapter imposing a time limit on parking shall not relieve any person
of the duty to observe other more restrictive provisions prohibiting
or limiting the stopping, standing or parking of vehicles, as set
forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter
provided.
B.
Parking prohibited during state of emergency.
(1)
Upon the declaration of an emergency, there shall
be no parking upon streets or sections of streets where temporary
EMERGENCY NO PARKING signs are displayed. The Chief of Police, or
in his absence the ranking police officer, shall be authorized to
declare an emergency and to direct the posting of EMERGENCY NO PARKING
signs when weather conditions, accidents, fires, public celebrations,
etc., dictate or require the avoidance of hazards or other conditions
which interfere with the free flow of traffic. Notification that EMERGENCY
NO PARKING signs are being or shall be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of the signs.
(2)
The effectiveness of this subsection is contingent
upon signs being erected as required by law.
C.
Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I (§ 229-10) attached to and made a part of this chapter.

D.
Parking prohibited during certain hours on certain streets. No person shall park a vehicle between the hours specified on any day, except Sundays and public holidays, upon any of the streets or parts of streets described in Schedule II (§ 229-11) attached to and made a part of this chapter.

E.
Parking time limited on certain streets. No person shall park a vehicle for longer than the time limit designated at any time between the hours listed on any day, except Sundays and public holidays, upon any of the streets or parts of streets described in Schedule III (§ 229-12) attached to and made a part of this chapter.
F.
Parking prohibited during certain hours on certain
months of the year.
(1)
No person shall park any motor vehicle on any public
street within the Borough between the hours of 1:00 a.m. and 6:00
a.m. prevailing time, each year between November 15 and April 1 of
the following year.
G.
No stopping or standing. No person shall stop or stand a vehicle, whether attended or unattended, upon any of the streets or parts of streets described in Schedule IX (§ 229-18) attached to and made a part of this chapter.

H.
Violations and penalties. Any person who shall violate
any provision of this chapter shall be fined a penalty of $25 unless
a specific penalty is otherwise provided.

I.
Overnight parking of vehicles in excess of 10,000
pounds gross vehicle weight prohibited.

J.
Parking prohibited when streets are snow or ice covered.

(1)
Whenever snow or ice has fallen and the accumulation is such that
it covers the streets and highways, an emergency shall exist and no
vehicle, nor any portion of the vehicle, shall be parked on any street
or highway or portions thereof.
(2)
The above parking prohibitions shall remain in effect until after
the snow or ice has ceased and the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
K.
Towing of vehicles.

(1)
Any police officer may move or cause to be moved any motor vehicle
parked in contravention to the terms of this section to a place designated
by the Chief of Police for the impounding of such vehicles.
(2)
Within 24 hours of such impoundment, the Chief of Police or his designee
shall notify, personally or by mail, the registered owner of the location
of the impounded vehicle.
(3)
Such vehicle shall not be released until the owner shall have paid
all reasonable towage, storage and other incidental charges connected
therewith which charges shall be set forth on a fee schedule on file
in the office of the Chief of Police. In the event of a dispute over
charges, the owner of the vehicle shall have the right to appeal the
validity of the charges to the Chief of Police who shall conduct a
hearing as soon as is practicable. If, after the hearing, the Chief
of Police determines that there is a legitimate basis to dispute the
billing, he shall order the vehicle released upon payment of the undisputed
amount and the parties may address the balance due in such legal proceedings
as they deem appropriate.
(4)
In addition to any reasonable charges of fees herein provided for,
any person convicted of violating the provisions of this subsection
shall be subject to fines as provided by law.
L.
Parking
limited to vehicles with parking tags.

(1)
Parking
of vehicles which do not have a Borough issued parking tag displayed
in a manner provided by a policy promulgated by the Borough Manager
shall be prohibited in municipal lots or property where and when signage
is posted indicating that parking tags are required.
(2)
The
Borough Manager and Police Chief shall determine where and when parking
in municipal lots and property shall be limited to parking tag holders
and shall direct the placement of signage to be posted indicating
that parking is limited to tag holders.
(3)
The
Borough Manager shall institute a policy for the design and issuance
of parking tags for parking in selected municipal lots and property
within the Borough.
A.
Purpose. The purpose of this section shall be to regulate
parking in the parking areas by limiting the same to parking only
by permit; to regulate parking in the Romaine Parking Area and on
public thoroughfares in the vicinity of the parking areas in order
to implement the provisions of this section and to avoid potential
traffic congestion which might be caused by the parking of motor vehicles
thereon instead of in the parking areas, and to charge a fee for permits
to assist in defraying the cost of implementing the provisions of
this section and of maintaining the parking areas.

ROMAINE PARKING PERMIT
Definitions. As used in this section, the following
words and phrases shall mean:
That portion of the premises, as hereinafter defined, used
for commuter and other parking of motor vehicles incident and accessory
to the use of the railroad station located on the premises, including
the "Esplanade Parking Area" lying to the north of the railroad tracks
and being Lot 3 in Block 1, as shown on the tax map of the Borough,
the "southerly parking area" lying to the south of the railroad tracks
and being a portion of Lot 2 in Block 1, as shown on the tax map of
the Borough, and the parking spaces now existing on and along the
southerly and easterly sideline of the access road or driveway to
the southerly parking area from Midvale Road, said access road or
driveway also being a part of said Lot 2 in Block 1.
A permit issued by the Borough Clerk, which shall be in the
form of a suitable sticker capable of being affixed to the rear window
on the driver's side of a motor vehicle and which shall constitute
permission and authorization during a given permit year to park a
motor vehicle in the parking areas in accordance with the terms and
provisions of this section.
A space within the parking areas and the Romaine Parking
Area for the parking of one motor vehicle.
That period of time beginning on May 1 in a given calendar
year and ending on April 30 of the next succeeding calendar year.
The Department of Police of the Borough.
Those lands owned by and within the Borough, acquired by
the Borough by deed from the Delaware Lackawanna & Western Railroad
Company, dated October 23, 1959, and recorded in the Morris County
Clerk's Office on December 4, 1959 in Book G-70 of Deeds, page 278,
said lands being also known and designated as Lots 2 and 3 in Block
1 of the tax map of the Borough.
The railroad station and facilities located on the premises.
Lots 1 and 2 in Block 108, as shown on the tax
map of the Borough, and owned by the Borough; and
All paved portions of the Romaine area as the
same presently exist, the same being generally bounded by the existing
basketball court on the west, by Midvale Road on the east, by Block
108 on the south and by Blocks 106 and 107 and Baldwin Lane on the
north.
A permit issued by the Borough Clerk, which shall be in the
form of a suitable sticker capable of being affixed to the rear side
window on the driver's side of a motor vehicle and which shall constitute
permission and authorization during a given permit year to park a
motor vehicle in the Romaine Parking Area for a period of time in
excess of three hours, in accordance with the terms and provisions
of this section.
C.
Parking restricted; permit required. No person shall
on any day park a motor vehicle in and on the parking areas for more
than three hours unless and until he shall have first applied for,
paid for and received a parking permit for the motor vehicle from
the Borough Clerk for a given permit year and shall have displayed
the parking permit on the motor vehicle, all as hereinafter set forth.

D.
Permit; application; fee.
(1)
A parking permit shall be obtainable from, and issued
by, the Borough Clerk. Application for a parking permit for a given
permit year shall be made to the Borough Clerk on forms supplied by
the Borough at any time within the permit year or within 30 days of
commencement of the permit year. Any person making application shall
pay a fee per permit year to the Borough Clerk for each motor vehicle,
as provided in § 111-3A.
(2)
The parking permit shall be good and effective only
during the permit year for which the same was purchased and issued
and only if and when affixed to the rear window on the driver's side
of the motor vehicle which is to be parked in such fashion or manner
as to be clearly visible from the rear of the vehicle when parked.
E.
Issuance.
(1)
The Borough Clerk shall, for each permit year, issue
parking permits to persons wishing to purchase and obtain the same
on a first-come, first-served basis, until all permits available for
the permit year have been issued.
(2)
He shall keep a record of each parking permit issued,
as well as of the name and address of each person to whom issued and
the make, year and license number of the motor vehicle for which issued.
The Borough Clerk shall account to the Borough for the charges collected.
F.
Replacement stickers. Application may also be made
to the Borough Clerk, on forms supplied by the Borough, during a given
permit year, for transfer of a parking permit to another motor vehicle
or for the replacement of a mutilated parking permit. Any such application
shall be accompanied by a fee, as set forth in § 111-3A.
Upon issuance of the replacement parking permit, the previously issued
parking permit shall become invalid and its use shall be illegal.
G.
Borough liability.
(1)
The Borough shall not:
(a)
Reserve any particular parking space for the
purchaser of a parking permit.
(b)
Guarantee the availability of a parking space
for any motor vehicle.
(c)
Assume liability in the event of unavailability
of a parking space.
(d)
Make a refund because of the possible unavailability
of a parking space or for any other reason.
(2)
There shall be no proration of the charge for a parking
permit for any reason, including issuance after commencement of the
permit year for which the same is issued, except that, for any application
made and any parking permit issued after the expiration of a period
of six months from commencement of the permit year, the fee as set
forth in § 111-3A shall be reduced by 50%.
H.
Regulations.
(1)
No person shall:
(a)
Park a motor vehicle in the parking areas, other
than within the boundary lines of a parking space.
(b)
Wash, paint, repair or otherwise work on or
in any motor vehicle in the parking areas, except that nothing herein
contained shall be construed to prohibit necessary emergency repairs
to a motor vehicle.
(c)
Violate or fail to comply with any and all rules
and regulations governing the parking of motor vehicles in the parking
areas which the Borough Council may, from time to time by ordinance,
promulgate.
(2)
By application and payment for and acceptance of a
parking permit, all persons acquiring the same shall accept and shall
be deemed to have accepted the terms, provisions and conditions of
this section.
I.
Romaine Parking Area.
(1)
Permit required; fee.
(a)
The provisions of Subsection I(1)(b) of this section, insofar as they impose a three-hour parking limit as therein set forth, shall not apply to persons who have applied, paid for and received a Romaine parking permit for a motor vehicle from the Borough Clerk for a given permit year and shall have displayed the parking permit on the motor vehicle.
(b)
A Romaine parking permit may only be applied
for by and may only be issued to an owner or employee, certified as
such in writing by the owner, of a business or commercial establishment
located either immediately adjacent to and fronting on the Romaine
Parking Area or on Baldwin Lane.
(d)
The fee per permit year for a Romaine parking
permit shall be as provided in § 111-3A.
(2)
Parking regulations. Except as provided in Subsection J of this section, no person shall park a motor vehicle, between the hours of 7:00 a.m. and 8:00 p.m. on any day, except Saturday, Sunday and legal holidays, for more than three hours in and on the Romaine Parking Areas or other than within the boundary lines of parking spaces designated therein for the parking of motor vehicles.
J.
Railroad station daily parking permit. In addition to the permits provided for elsewhere in this § 229-4, a dated permit for parking at the Railroad Station Parking Area for one day only shall be obtainable at the Police Department upon payment of the fee provided for in § 111-3A(6).

K.
Signs. Any and all signs necessary and proper to implement
the terms and provisions of this section shall be installed and erected
under the direction and supervision of the Police Department.
L.
Revocation of permit. Any parking permit or any Romaine
parking permit may be revoked for any of the following reasons:
(1)
A false representation as to ownership of a motor
vehicle or the residence of the owner or the location of a business
or commercial establishment or the employment status of an employee.
(2)
Use of a parking permit or a Romaine parking permit
on a motor vehicle other than that for which such permit was granted.
(3)
The commission by the holder of a parking permit of
any act in violation of the terms and provisions of this section or
of any rule or regulation pertaining thereto which may be adopted
by the Borough Council.
(4)
Withdrawal of use of the facilities or discontinuance
of the operation thereof by the Borough.
M.
Enforcement; removal of vehicles. The Police Department
shall enforce this section and shall, by issuance of a summons and
complaint, charge any person for any violation thereof. In addition,
the Police Department may remove or cause to be removed, from the
parking areas, the Romaine Parking Area and the public streets, places
or other thoroughfares set forth in Schedules I, II and III of this
chapter, any unattended motor vehicle parked, remaining or standing
in any portion thereof in violation of this section. When a motor
vehicle is so removed, the owner of the vehicle shall pay, before
being entitled to the recovery or possession of the vehicle, all reasonable
charges for towing, storage and other expenses incurred in the removal
thereof.
A.
Stop intersections. The intersections described in Schedule IV (§ 229-13), attached to and made a part of this chapter, are hereby designated as stop intersections. Stop signs shall be installed as provided therein.

B.
Through streets. The streets or parts of streets described in Schedule V (§ 229-14), attached to and made a part of this chapter, are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street, except where yield signs are provided for in the designations.

C.
Yield intersections. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VI (§ 229-15), attached to and made a part of this chapter, are hereby designated as yield intersections. Yield signs shall be installed as provided therein.

D.
Vehicle weight limitations. Vehicles over the gross weight indicated are hereby excluded from the street or parts of street described in Schedule VIII (§ 229-22) attached to and made a pad of this chapter, except for the pickup and delivery of materials on such streets.

The streets or parts of streets described in Schedule VII (§ 229-16), attached to and made a part of this chapter, are hereby designated as one-way streets in the direction indicated.

No-passing zones for both directions of traffic along the roadways listed in Schedule VIII (§ 229-17) shall be established as listed. Regulatory and warning signs shall be erected and maintained to effect the designated speed limits as authorized by the Department of Transportation.
A.
A speed limit of 25 miles per hour (mph), as fixed
by N.J.S.A. 39:4-98b, shall be fixed upon all public streets, with
the exception of the following streets:

Filing of consent. Olga and Mildred Schwart, owners
of Willow Drive, have filed a written consent with the Borough of
Mountain Lakes that the provisions of Subtitle 1 of Title 39 of the
Revised Statutes of New Jersey be made applicable to the semipublic
road, Willow Drive, located in the Borough of Mountain Lakes, County
of Morris; the following regulations shall be enforceable.

(5)

to obstruct or impede a normal flow of traffic, block entrances or
exit ways, loading zones, oil fills, any grassy area, pedestrian walkway
or present in any way a safety or traffic hazard may be removed by
towing the vehicle at the owner's expense.
(6)
Signage. All signs, posts or other necessary materials
shall be installed and shall conform to the current Manual on Uniform
Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A.
39:4-183.27.
(7)
Penalty for violation. Unless another penalty is expressly
provided by New Jersey statute, every person convicted of a violation
of this section or any supplement thereto shall be liable to a penalty
of not more than $100 or imprisonment for a term not exceeding 15
days, or both.
B.
Wildwood Elementary School.

(1)
Filing of consent. The Mountain Lakes Board of Education,
owners of the Wildwood Elementary School, Block 87 and Lot 12 on the
Mountain Lakes Tax Maps, and the property upon which it is situated,
has filed a written consent with the Borough of Mountain Lakes that
the provision of Subtitle 1 of Title 39 of the Revised Statutes of
New Jersey be made applicable to the semipublic or public roads, streets,
driveways, trails, parking areas or other roadways open to or used
by the public, employees, students, parents and other persons for
purposes of vehicular travel located in and around the school.
(2)
General parking. No person shall stop or stand a vehicle
at any time except in the areas specifically designated by the Board
of Education.
(3)
Speed limits. The speed limit for both directions
of travel on the property shall be 25 miles per hour as prescribed
by law.
(4)
Tow-away zones. Any vehicle parked or standing in
other than a specifically designated area or as to obstruct or impede
a normal flow of traffic, block entrances or exitways, loading zones,
oil fills, a grassy area, pedestrian walkway or present in any way
a safety or traffic hazard may be removed by towing the vehicle at
the owner's expense.
(5)
Signage. All signs, posts or other necessary material
shall be installed and shall conform to the current Manual on Uniform
Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A.
39:4-183.27.
(6)
Penalty for violation. Unless another penalty is expressly
provided by New Jersey statutes, every person convicted of a violation
of this section or any supplement thereto shall be liable to a penalty
of not more than $100 or imprisonment for a term not exceeding 15
days, or both.
