All division or partition fences between the lands of any two or more
adjoining owners, whether built or erected as division or partition fences
between such lands and whether the same exist or are erected entirely or only
partly upon the lands of any such adjoining owners or along or immediately
adjacent to any division or partition lines of such lands, consisting of posts
and rails, timber, boards, brick or stone walls, hedges and all other kind
or character of fences, shall not exceed four feet two inches in height, measured
from the level or surface of the earth and shall not exceed two feet in width.
A.
The place where any partition fence is or shall be made
shall be equally divided, regard being had to the quantity of fence necessary
and other conveniences of fencing. Each party shall take an equal share of
such fence to make or amend and maintain so that it may be known which part
thereof is his own.
B.
If the parties cannot agree to the making of such division,
the Public Service Committee of the Council, being disinterested and indifferent
between the parties, shall, on the application of either party, in the presence
of the parties if they desire to be present, make such division and determine
the part of such fence which each party is to make or mend and maintain, pursuant
to the statute in such case made and provided.[1]

Any person violating or failing to comply with any of the provisions
of this chapter shall, upon conviction thereof, be subject to a fine of not
less than $100 nor more than $1,000, imprisonment for a term not exceeding
90 days and/or a period of community service not exceeding 90 days. Each day
such violation is committed or permitted to continue shall constitute a separate
offense and shall be punishable as such.
