As used in this chapter, the following terms shall have the meanings indicated:
SHOPPING CART
Four-wheeled shopping carts owned and furnished by the owners or proprietors of stores and supermarkets and used by customers and shoppers of said stores and supermarkets, with the permission of the owners or proprietors of said stores and supermarkets, to transport merchandise purchased by the customers and shoppers to parking lots or other parking places provided by the owners or proprietors of such stores or supermarkets for the convenience of their patrons or customers.
No person shall remove any shopping cart from the said stores or supermarkets or parking lots or parking places at premises provided by the owners or proprietors of said stores or supermarkets without the express consent or permission of the owners or proprietors of said stores or supermarkets.
No person shall abandon or otherwise leave upon any public sidewalk, street or other public or private property in this city any shopping cart without the express written consent of the owner of said shopping cart.
Except as otherwise provided by this chapter, all shopping carts shall be returned by the users thereof to the stores or supermarkets from which they were taken, immediately upon the transportation of said merchandise for which they were used by the patrons or customers without delay or damage thereto.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine of not less than $100 nor more than $1,000, by imprisonment for a term not exceeding 90 days and/or a period of community service not exceeding 90 days.
