As used in this chapter, the following terms shall have the meanings indicated:
ABANDONED or JUNKED VEHICLES
Any partially dismantled, nonoperating, wrecked, junked or discarded motor vehicle.
No person shall abandon any motor vehicle within the limits of the city nor shall he leave any motor vehicle at any place within the city for such time and under such circumstances as to cause the same to appear to have been abandoned.
Any abandoned or junked vehicles owned by any person or in his possession or control parked or permitted to be parked on any property within the city limits for a period longer than 72 hours is hereby declared to be a public nuisance.
A. 
No person in charge or in control of any property within the city, whether as owner, tenant, occupant, lessee or otherwise, shall park or allow or permit to be parked any abandoned or junked vehicle, owned by him or under his possession or control, on such property longer than 72 hours.
B. 
The failure to remove the abandoned or junked vehicle pursuant to the notice prescribed by § 276-5 shall constitute a violation of this chapter.
The Chief of Police or any member of the Police Department designated by him, after becoming aware of a violation of § 276-4A, shall forthwith give written notice of such violation to the person in charge or in control of the property within the city. Such notice shall order the person to whom it is directed to remove the abandoned or junked vehicle within 24 hours after the receipt of such notice.
A. 
Upon the failure to comply with the notice referred to § 276-5, the abandoned or junked vehicle shall be removed from the property by or under the direction of the Police Department.
B. 
Upon taking possession of such abandoned or junked motor vehicle, the Police Department shall follow the procedures established by L. 1964, c. 81 (N.J.S.A. 39:10A-1 et seq.) to sell such vehicle at public auction.
C. 
A licensed tow operator who has towed a vehicle at the direction of the Pleasantville Police Department and has taken possession of the same shall follow the policies and procedures established under § 269-16.

The provisions of this chapter shall not apply to any vehicle in an enclosed building or on the premises of a business enterprise operated in a lawful place and manner when necessary to the operation of such business enterprise.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both.
