The provisions of this article shall apply except
when it is necessary to stop a vehicle to avoid conflict with other
traffic or in compliance with the directions of a police officer or
official traffic control device.
Wherever a space shall be marked off on any
street for the parking of an individual vehicle, every vehicle there
parked shall be parked within the lines bounding such space.
The parking of vehicles is prohibited at all
times in those streets or parts of streets described in Schedule XII.
The parking of vehicles is hereby prohibited
between the hours of 4:00 a.m. and 7:00 a.m., on the designated days,
in those locations described in Schedule XIII.
The stopping and standing of vehicles is hereby
prohibited in the locations described in Schedule XIV.
The parking of vehicles is hereby prohibited
in the locations described in Schedule XV, during the times indicated.
The parking of vehicles is hereby prohibited
in the locations described in Schedule XVI for a longer period of
time than that designated, during the hours indicated.
The locations described in Schedule XVII are
hereby designated as bus stops, and the parking of vehicles is hereby
prohibited in such locations.

The locations described in Schedule XVIII are
hereby designated as taxi stands.
A.
When stopping is prohibited by local law, ordinance,
order, rule or regulation, no person shall stop or park a vehicle,
whether occupied or not, except when necessary to avoid conflict with
other traffic, or in compliance with the direction of a police officer
or traffic control sign or signal.
B.
When standing is prohibited by local law, ordinance,
order, rule or regulation, no person shall stand or park a vehicle,
whether occupied or not, but may stop temporarily for the purpose
of and while actually engaged in receiving or discharging passengers.
C.
When parking is prohibited by local law, ordinance,
order, rule or regulation, no person shall park a vehicle, whether
occupied or not, but may stop or stand temporarily for the purpose
of and while actually engaged in loading or unloading merchandise
or passengers.
D.
When official signs have been posted prohibiting,
restricting or limiting the stopping, standing or parking of vehicles
on any public street in the Village of Northport, no person shall
stop, stand or park any vehicle in violation of the restriction stated
on such signs.
E.
No person shall stop, park or leave standing any vehicle,
whether attended or unattended, upon the paved or main-traveled portion
of any public street in the Village of Northport when it is practicable
to stop, park or so leave such vehicle off such part of said roadway,
but in any event an unobstructed width of the roadway opposite a standing
vehicle shall be left for the free passage of other vehicles, and
a clear view of such stopped vehicle shall be made available from
a distance 200 feet in each direction upon such roadway. This section
shall not apply to the driver of any vehicle which is disabled in
such a manner and to such extent that it is impossible to avoid stopping
and temporarily leaving such vehicle in such position.

A.
No person shall park or leave unattended any boat
trailer or motor vehicle with a boat trailer attached on any street
in the Village of Northport except while actually engaged in the loading
or unloading thereof.
B.
Parking of commercial vehicles on Village streets.
(1)
Prohibited parking. No person shall park or leave
unattended any commercial vehicle on any Village street or in any
parking lot owned or maintained by the Village of Northport between
the hours of 4:00 a.m. and 7:00 a.m., except while actually engaged
in the loading or unloading of the same or rendering of services for
which the vehicle is a necessary attribute. This provision shall not
be applicable to the parking of certain commercial vehicles not bearing
any writing, drawing, picture, painting or announcement of a commercial
advertising nature on any street or in any parking lot owned or maintained
by the Village of Northport, provided that a permit is affixed to
said vehicles pursuant to the provisions of the following subsection.
(2)
A person may park or leave unattended certain commercial vehicles on any Village street not listed in Schedule XIX, provided that a permit for such parking shall have been issued by the Village Clerk after application and payment of an annual fee in the amount as set forth from time to time by resolution of the Board of Trustees; see Chapter 147, Fees. Said permit shall expire on the first day of July next following issuance. Only one permit shall be issued per dwelling unit, including apartments in a multifamily residence, for any commercial vehicle having a gross weight of less than 3/4 ton and also having no more than four wheels.
(a)
Each permit issued shall be affixed to the left
side of the rear bumper of the vehicle.
(b)
Any permit may be revoked after notice of the
Chief of Police of the Incorporated Village of Northport or his designee
for a materially false statement made on the application form to be
completed by each applicant, annually, prior to the issuance of the
permit. Such application form shall be promulgated by the Chief of
Police of the Incorporated Village of Northport, requiring each applicant
to supply any information necessary for issuance of said permit hereunder.
(3)
For the purposes of this section, the term "commercial
vehicle" shall be defined as any motor vehicle other than a passenger
car, including but not limited to vans, trailers, semitrailers, tractors,
trailer cabs and the like, notwithstanding the classification of New
York State registration.
C.
No person shall park or leave unattended any vehicle in a parking space designated "Handicapped Parking" without displaying the required permit. Handicapped parking places are listed in § 282-69, Schedule XXI.
D.
No person shall park or leave unattended any vehicle
on any street or in any parking lot which is owned or maintained by
the Village of Northport which is not currently registered as required
by Article 14 of the New York State Vehicle and Traffic Law or which
does not display a current or valid registration as required under
Article 14 of the New York State Vehicle and Traffic Law.

A.
There is hereby established a Handicapped Parking
Violations Unit, as authorized by § 1203-f of the Vehicle
and Traffic Law, within the Police Department. Such unit shall be
under the supervision and direction of the Police Chief.
B.
Such unit shall be comprised of no more than 10 volunteers.
As authorized by § 1203-f of the Vehicle and Traffic Law,
each such volunteer shall be appointed by the Board of Trustees of
the Incorporated Village of Northport. Each such volunteer so appointed
shall serve without compensation for a term of two years.
C.
The volunteers so appointed shall assist the Incorporated
Village of Northport in enforcement of handicapped parking violations
as provided in this section.
D.
A volunteer person so appointed shall not be authorized
nor assigned to perform any duties of assisting enforcement as provided
herein until such person shall participate and complete a training
program as provided in this section.
E.
Equipment and forms.
(1)
Each appointed volunteer shall be given an official
identification with an identification number displayed thereon as
well as a photograph of such volunteer. Such volunteer shall be given
equipment and aids, including but not limited to a camera and forms
for recording all violations. Each such form shall be delivered by
the volunteer to the Police Chief.
(2)
Such forms shall contain a space for entry of the
date, time and location of the violation, the charged violation, description
of the motor vehicle, the registration plate of such motor vehicle
and the date of registration and a space for the signature and the
identification number of such volunteer. Such form shall also state
whether a photograph or recording was taken and require the delivery
of the photograph or recording to a particular location for processing.
If a photograph or recording was taken and requires processing, the
Police Department shall process the photograph or recording.
(3)
Any such photograph or recording that is used as evidence
of a violation shall be available for inspection in any proceeding
to adjudicate the liability for such violation. A certification sworn
to or affirmed by a Village employee designated by the Police Chief
to administer the program shall state that the photograph is the original
produced from the film submitted by the volunteer or that the recording
is the original, or a true and accurate copy of such photograph or
recording submitted. Such certification shall be prima facie evidence
of the facts in the photograph or recording. Such photograph or recording
shall be used only for evidence of handicapped parking violations
and not for any other purpose.
F.
Notice of violation.
(1)
A notice of violation shall contain the charged violation,
the registration number of such motor vehicle, the date, time and
location of the violation, the amount of any fine and the identification
number of the volunteer.
(2)
Such notice of violation shall be mailed to each owner
by first class mail. A manual or automatic record of such mailing
made in the ordinary course of business shall be prima facie evidence
of mailing of such notice.
G.
A volunteer appointed to assist in enforcement of
handicapped parking violations shall be required to attend and complete
a training program of a least two hours in duration, which shall include
at a minimum the following:
(1)
Instruction and review of all laws, rules, regulations
and ordinances relating to handicapped parking.
(2)
Instruction on who is considered handicapped and entitled
to utilize handicapped parking.
(3)
Instruction on how to determine whether a violation
has occurred or how to determine the applicable law, rule, regulation
or ordinance.
(4)
Instruction and review of the procedure to be followed
by each volunteer for taking evidence and reporting violations.
(5)
Instruction, demonstration and practice of the use
of cameras or other equipment and aids supplied to the volunteer assisting
in enforcement of handicapped parking violations, and such other training
as deemed appropriate for the specific duties of such a volunteer.
(6)
Instruction on conduct in taking evidence of a violation
and in dealing with the public and the purported owner and/or operator
of a motor vehicle parked in violation of a handicapped violation
law or ordinance.
(7)
Instruction on identifying a motor vehicle and the
entry into the form of a description of a motor vehicle and other
information required to be entered on such form.
