The special act establishing the Agency was approved July 24, 1976.
Editor's Note: The Act referred to is Chapter 783 of the Laws of 1976, which added § 903-e in Title 2, Article 18-A, of the General Municipal Law, as follows: "§ 903-e. City of Schenectady industrial development agency. For the benefit of the City of Schenectady and the inhabitants thereof, an industrial development agency, to be known as the "City of Schenectady industrial development agency," is hereby established for the accomplishment of any or all of the purposes specified in Title 1 of Article 18-A of this chapter. It shall constitute a body corporate and politic and be perpetual in duration. It shall have the powers and duties now or hereafter conferred by Title 1 of Article 18-A of this chapter, upon industrial development agencies and provided that the exercise of the powers by such agency with respect to the acquisition of real property, whether by purchase, condemnation or otherwise, shall be limited to the corporate limits of the City of Schenectady, and such agency shall take into consideration the local zoning and planning regulations, as well as the regional and local Comprehensive Land Use Plans. It shall be organized in a manner prescribed by and be subject to the provisions of Title 1 of Article 18-A of this chapter. Its members shall be appointed by the governing body of the City of Schenectady. The agency, its members, officers and employees and its operations and activities shall in all respects, be governed by the provisions of Title 1 of Article 18-A of this chapter."
The name of the Agency is the "City of Schenectady Industrial Development Agency."

Facts establishing a need for an Industrial Development Agency in Schenectady include:
For the past decade, Schenectady, especially its Central Business District, has suffered the consequences of decreasing investment. Retail stores have closed and businesses have moved, resulting in the reduction of the real property tax base through both in rem foreclosures and certiorari actions.
Industrial and commercial firms in other sections of the City have moved from the City or closed operations. This has contributed to higher unemployment in Schenectady.
The City of Schenectady Industrial Development Agency will be charged with the task of revitalizing the City's economy by making efforts to retain those industrial and commercial firms presently located in the City, attempting to create in Schenectady an economic climate attractive to new firms, and reversing the trend of increasing numbers of vacant and deteriorating buildings in the downtown and thereby decreasing the unemployment rate.

There will be seven members of the Schenectady Industrial Development Agency appointed by the City Council. Each member of the Agency shall serve at the pleasure of the Council and shall continue to hold office until a successor is appointed and has qualified. No person may be appointed to serve as a member of the Schenectady Industrial Development Agency unless that person resides within the City of Schenectady.
