A.
Any owner who, having been served with a notice or
order to remove any violation of this chapter or any nuisance, fails
to comply therewith within the time fixed by the Department shall
be guilty of an offense, punishable for each offense by a fine or
penalty not exceeding $500. Every day of such violation may be held
to constitute a separate offense.
B.
Any person who owns, operates or manages a business
subject to this article, who does so without such certificate of use
having been issued and validly in force, shall be guilty of a violation,
punishable by a fine of not less than $500 nor more than $1,000 or
imprisonment for 30 days, or both.
C.
The term "owner" as used in this section shall include
any entity, person or persons deemed to be an owner or owners of property.
D.
Violations of this chapter may be referred to the
Law Department, wherein violators shall be subject to the penalties
set forth above and, in addition, injunctive relief to cause the cessation,
closure or abatement of the violation.
The several provisions of this chapter shall
be severable in accordance with the following rules:
A.
If any court of competent jurisdiction shall adjudge
any provision of this chapter to be invalid, such judgment shall not
affect any other provision of this chapter.
B.
If any court of competent jurisdiction shall adjudge
invalid the application of any provision of this chapter to a particular
structure, such judgment shall not affect the application of said
provision to any other structure.
