A. 
The Commission or, if appropriate, the County Commissioners may, after consultation with the County Attorney, grant exemptions to or modification of provisions of this chapter for a member or prospective member of a County board or commission if, because of the nature of the board or commission, it is determined that:
(1) 
The application of this chapter to that board, commission, member, or prospective member would:
(a) 
Constitute an unreasonable invasion of privacy; or
(b) 
Reduce the availability of uniquely qualified individuals for public service; and
(2) 
The exemption or modification is not contrary to the overall purposes of this chapter.
B. 
The Commission or, if appropriate, the Commissioners, may grant an exemption or modification authorized under Subsection A of this section only on the written request of the board, commission, member, or prospective member involved.
