The declaration of any portion of this chapter by a court of competent
jurisdiction to be invalid shall not invalidate the entire chapter but only
that part so declared to be invalid, and the remainder of said chapter shall
remain in full force and effect.
Upon adoption by the Town Board, this chapter shall take effect 10 days
after its publication and posting as required by the laws of the State of
New York, except that this chapter shall take effect from the date of its
service as against a person served personally with a copy thereof, certified
by the Town Clerk under the corporate seal of the town, showing the date of
its passage and entry in the minutes.
A.
The violation of any of the provisions of this chapter
is an offense for which the violator shall be subject to a fine of not more
than $250 or to imprisonment for a period of not more than 15 days, or both.
Each week's continued violation shall constitute a separate and additional
violation and shall be punishable hereunder.
B.
In addition to the foregoing penalties,
the Town of Cheektowaga may institute any appropriate action or proceeding
to prevent, correct or restrain any violation of this chapter.
