A. 
Words and phrases used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them by Article I of the Vehicle and Traffic Law of the State of New York.
B. 
The following words and phrases which are not defined by Article I of the Vehicle and Traffic Law of the State of New York shall have the meanings respectively ascribed to them in this section for purposes of the traffic ordinances of this town:
CURBLINE
The prolongation or connection of the lateral line of the curb or, in the absence of a curb, then the lateral boundary line of the roadway.
HOLIDAYS
New Year's Day, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day.
MEASUREMENTS
Any linear measurements specified for various orders, rules and/or regulations contained in or adopted and/or issued pursuant to this chapter shall be deemed to be approximate. Such measurements and the order, rule and/or regulation to which they pertain shall not be affected or altered in any way by the widening of a street, by the construction of curbs, gutters or sidewalks or by any other action which might tend to obliterate the point from which such measurements were originally made. Unless otherwise indicated, measurements shall be made from the nearest curbline of the street(s) referred to in a location description or, if there is no curbline, from the nearest edge.
OFFICIAL TIME STANDARD
Whenever certain hours are named herein or on traffic control devices, they shall mean the time standard which is in current use in this state.
The Chief of Police shall install and maintain traffic control devices when as required under the provisions of this chapter, to make effective the provisions of this chapter. He may install and maintain such additional traffic control devices as he may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York, subject to the provisions of § 1682 and § 1684 of that law.
A. 
It shall be the duty of the Cheektowaga Police Department or other designated police officials duly authorized to act within this Town to enforce the provisions of this chapter. Police officers are hereby authorized to direct all traffic either in person or by means of visible signals in conformity with the provisions of this chapter.
B. 
In the event of fire, accident or other emergency or to expedite traffic or safeguard pedestrians, officers of the Police or Fire Department and authorized school crossing guards may direct traffic as such conditions may require, notwithstanding the provisions of this chapter.
The traffic pavement markings upon New York State roadways are hereby applicable to Town and county roadways in the Town of Cheektowaga. Said markings, when placed upon Town and county roadways, shall have the same meaning and effect as similar markings upon state roads in this town. Violations of such markings upon said Town and county roadways shall be subject to the same penalties as violations of such markings on state roadways.
A. 
This chapter shall apply to the operator of any and all vehicles, except such authorized emergency vehicles as are defined in the Article I of the Vehicle and Traffic Law of the State of New York while operating in an emergency or in the necessary performance of public duties.
B. 
Every person propelling any pushcart, riding a bicycle or riding or driving an animal upon the highways shall be subject to the provisions of this chapter applicable to the operator of any vehicle.
A. 
For the purposes of maintaining an accurate record of all regulations adopted under the provisions of this chapter, there is hereby established a system of schedules, appearing as Article V of this chapter, in which shall be entered all regulations after adoption. Such schedules shall be deemed a part of the section to which they refer. All regulations shall be adopted with reference to appropriate schedule as indicated in the various sections of this chapter.
B. 
Regulations shall be adopted by the Cheektowaga Town Board in accordance with the provisions of the New York State Town Law and the Vehicle and Traffic Law, or by an officer or agency authorized by the Town Board to adopt regulations pursuant to § 1603 of the Vehicle and Traffic Law.
If any article, section, subsection, paragraph, sentence, clause or provision of this chapter shall be adjudged by any court of competent jurisdiction to be invalid, such adjudication shall not affect, impair or invalidate the remainder thereof. Such adjudication shall be confined in its operation to the article, section, subsection, paragraph, sentence, clause or provision thereof directly involved in the controversy in which such judgment shall have been rendered.
A. 
Except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York, this chapter and any regulations adopted hereunder shall take effect as provided by law.
B. 
Any part or parts of this chapter and any regulations adapted hereunder which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York shall take effect from and after the day on which approval, in writing, is received from the New York State Department of Transportation.
All prior ordinances, regulations and rules, or parts thereof, of this Town regulating traffic and parking are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person or any act done or committed in violation of any ordinance, regulation or rule hereby repealed prior to the taking effect of this chapter.
Every person convicted of a traffic infraction for a violation of any provision of this chapter, which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York, shall for a first conviction thereof be punished by a fine of not more than $250 or by imprisonment for not more than 15 days, or by both such fine and imprisonment. For a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $500 or by imprisonment for not more than 15 days, or both such fine and imprisonment. Upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $750 or by imprisonment for not more than 15 days, or by both fine and imprisonment.
The provisions of this chapter shall apply to all areas of the Town of Cheektowaga, Erie County, New York, outside the Villages of Depew and Sloan.
