Pursuant to the authority of § 130 of the Town Law of the State of New York, no person shall park, stand, store or leave a motor vehicle upon any public or privately owned premises or property, parking area or parking lot, without the consent and permission of the owner or lessee of such premises.
A. 
To effectuate the prohibition on such premises above described, a conspicuous sign or signs shall be posted at the entrances to such parking lots or parking areas, informing the public as to the permitted conditions for parking thereon. A sign as hereinafter described shall be deemed substantial compliance with this section.

POLICE ENFORCEMENT
B. 
Such signs shall be at least three feet high by four feet wide, with red lettering of a size not less than above indicated upon a white background. The words "police enforcement" and "under penalty of law" on such signs shall be construed, among other things, to mean a request by the owner or lessee that the police or special patrolmen shall enforce the provisions of this article against persons parking, standing, storing or leaving vehicles on such premises without the consent of the owner or lessee and that the police are authorized to enter upon such premises to enforce the provisions of this article. Such signs shall state the conditions of parking or the persons authorized by the owners or lessee to use said premises for parking, or both; and persons included within such authorization, or violating the regulations and conditions set out on said signs, shall be deemed to be using said promises unlawfully without the authority and consent of the owner or lessee.
This article may be enforced by the police or special patrolmen in the same manner as elsewhere provided for in the traffic ordinances of the Town of Cheektowaga for the enforcement of traffic or parking ordinances, including the use of tags, summonses and any other procedures authorized by law.
Proof of ownership of a vehicle shall be presumptive evidence in an action for enforcement of this article that the owner parked or caused his vehicle to be parked on such premises.
A. 
On demand of a police officer, any owner or lessee requesting police enforcement of this article shall furnish to the police officer a statement in writing, signed by him or his agent, to the effect that a specified vehicle was unlawfully parked, stored or left upon his premises at a certain time or during a certain period without his consent or permission. Such owner or lessee shall be available to testify to such facts in court at the request of the police.
B. 
Failure of an owner or lessee to comply with the request of the police as above set out shall be sufficient cause for the Chief of Police or his subordinates to ceases enforcing this article on behalf of an owner or lessee who fails to give the cooperation required herein.
A. 
No person shall stop, stand or park a vehicle in any of the following areas designated as places for handicapped parking unless the vehicle bears a special municipal parking permit issued under § 1203a of the Vehicle and Traffic Law of the State of New York or a registration and disabled person license plates issued under § 404-a of the Vehicle and Traffic Law of the State of New York and such vehicle is being used for the transportation of a severely disabled or handicapped person:
Cheektowaga Town Hall - south parking lot: four spaces.
Cheektowaga Town Park - north parking lot of Cheektowaga Recreation Center: two spaces.
Cheektowaga Town Park - south parking lot of Cheektowaga Cultural Center: four spaces.
Cheektowaga Town Park - south parking lot of Cheektowaga Recreational Center: two spaces.
Cheektowaga Senior Citizen Center - first five spaces west of the center mall: five spaces.
B. 
The Town Clerk shall issue such special municipal parking permits upon application by any handicapped person who is a resident of the Town, in accordance with the Guidelines for Determining Eligibility for Handicapped Parking Permits promulgated by the State of New York Office of Advocates for the Disabled.
A. 
All off-street parking restrictions within the Town of Cheektowaga shall be posted in accordance with the New York State Vehicle and Traffic Law, Article III of Chapter 235 of the Cheektowaga Town Code, and the Manual of Uniform Traffic Control Devices.
B. 
Handicap parking spaces shall be posted in accordance with § 1203-c, Subdivision 2(a), of the New York State Vehicle and Traffic Law. If signs are not posted at each handicap parking space, two signs shall be used for no more than three contiguous parking spaces.
