This township hereby signifies its intention and desire to organize an Authority (the "Authority") jointly in a group consisting of the Boroughs of Hatfield, Lansdale and Souderton and the Townships of Franconia, Hatfield, Lower Salford, New Britain, Skippack, Towamencin and Worcester, under the provisions of the Municipality Authorities Act of 1945, as amended.[2]

The initial project to be undertaken by the Authority is to acquire, hold, construct, improve, interconnect, maintain, operate, own and lease, either in the capacity of lessor or lessee, waterworks, sources of water supply, water rights and allocations, water supply works and water distribution systems, in the above-mentioned municipalities or any of them, or anywhere else, and for such municipalities or any of them and for such other territory as it may be authorized to serve.
The President and Secretary of the Board of Supervisors are hereby authorized and directed to execute, on behalf of the Township of Franconia, Articles of Incorporation for the Authority in substantially the form presented to this meeting which is hereby approved and is ordered to be filed with this article.[1]

The Township Secretary is hereby directed to cause a notice of the substance of this article to be published (separately or jointly with respect to similar ordinances adopted by other municipalities) once in the legal periodical for Montgomery County and once in a newspaper published and of general circulation in such county pursuant to the Municipality Authorities Act of 1945, as amended.[1]

The President and Secretary of the Board of Supervisors are directed to file said Articles of Incorporation, together with the necessary proofs of publication, with the Secretary of the commonwealth and to do all other acts and things necessary or appropriate to effect the incorporation of the Authority.
Section 6 of the Authority's Articles of Incorporation shall provide that the respective municipalities which are incorporating members of the Authority shall each have one representative on the Board of the Authority.[1]

This article shall become effective when ordinances substantially similar to this (except, in the case of the boroughs, for the addition of a section with respect to the transfer of existing water systems) have been enacted by the Boroughs of Lansdale and Souderton and the Townships of Franconia, Hatfield, Lower Salford and Towamencin.

It is the desire of the Supervisors of the Township of Franconia, Montgomery County, Pennsylvania, and said Supervisors hereby signify their intention, to organize an Authority under the Municipality Authorities Act of May 2, 1945, P.L. 382, as amended.[1]

In pursuance of said desire and intention, and in conformity with the terms and provisions of the said Municipality Authorities Act and its amendments, the proposed Articles of Incorporation are hereby set forth in full as follows.[1]

Said Authority shall be for the purpose of acquiring, holding, constructing, improving, maintaining and operating, owning, leasing, either in the capacity of lessor or lessee, projects of the following kind and character: buildings and structures to be devoted wholly or partially for public use and for revenue purposes, sewers, sewer systems or parts thereof, sewage treatment works and all facilities in any way used, useful, necessary, convenient or incidental to the furtherance and operation of sanitary sewage disposal system. No contract shall be entered into or obligation incurred by the Authority without the prior written approval of the township, and any such contract or obligation in violation hereof shall be in excess of the powers of the Authority.
Said proposed Articles of Incorporation of said Authority shall be executed by and on behalf of the Township of Franconia by the Chairman of the Board of Supervisors and attested by the Township Secretary, and the Seal of said township shall be thereto affixed, and filed with the Secretary of the Commonwealth. The Solicitor is hereby authorized and directed to publish notice of this article and of the day upon which said Articles of Incorporation will be filed with the Secretary of the Commonwealth of Pennsylvania; to file said Articles of Incorporation, together with the ordinance authorizing the incorporation of the Authority and the necessary proofs of publication, and to do all other things necessary or appropriate to effect the incorporation of the Franconia Sewer Authority.
