There is hereby created a museum board to be known as the "Dr. Thomas Robinson Kerr Memorial Museum Board" of the Borough of Oakmont (the "Museum Board" hereinafter).
A. 
The Museum Board shall be composed of seven members, to be appointed by the Borough Council of the Borough of Oakmont, with the power to provide, conduct and maintain the Dr. Thomas Robinson Kerr Memorial Museum buildings and grounds, subject to all such reasonable regulations as may be established by the Trustees from time to time.

B. 
The Board Members shall serve for terms of five years, or until their successors are appointed, except that the members of such Board first appointed shall be appointed for such terms that the term of at least one member shall expire annually thereafter. Vacancies shall be filled in the same manner as original appointments and for the unexpired term.
C. 
Members shall serve without pay.
The following persons, residents of the Borough of Oakmont, are hereby first appointed members of said Board, as provided by law, for the respective terms, as hereinafter shown:
Mr. Jeffrey Allen for the term ending December 31, 1999.
Mr. Thomas L. Fusia for the term ending December 31, 2000.
Mr. Vincent Provenza for the term ending December 31, 2001.
Ms. Jan Shoop for the term ending December 31, 2002.
Ms. Nancy Voss for the term ending December 31, 2003.
The Museum Board shall appoint from its membership a Chairperson and such other officers as it may deem necessary for the orderly procedure of its business and may adopt bylaws, rules and regulations covering its procedures not inconsistent with the provisions of commonwealth law. The Museum Board shall, from time to time, make rules governing the operation and conduct of the Museum facilities operated by the Board. The Board shall hold regular meetings at such times and places as it may designate.
The Museum Board shall maintain, operate and supervise the property located at 400 Delaware Avenue, Oakmont, Allegheny County, Commonwealth of Pennsylvania, as well as the tangible property located therein for the purpose of public exhibition and preservation as an historic home and as a museum.
The Museum Board may accept any grant, gift, bequest, donation or services, equipment, real estate, or money from any individual or group, to be used as specified by the donor, or by the terms of acceptance. The Board shall have no authority to enter into any contract or incur any obligation binding upon the Borough of Oakmont, other than current obligations or contracts to be fully executed within the then-current fiscal year, and all within the budget appropriations made by the Council of the Borough of Oakmont.
Any fund appropriated by the Council of the Borough of Oakmont and budgeted to the Museum Board shall be disbursed by the fiscal disbursing officer of the Borough of Oakmont, upon vouchers issued by the Museum Board and within the budget appropriations made. Funds received by the Board from sources other than budget appropriations shall be deposited by the Borough of Oakmont, to the credit and for the use of the Board and disbursed as the above budget funds are disbursed in accordance with the terms of such gift or bequest, or the terms of the acceptance thereof.
The Museum Board shall make full and complete reports to Borough Council at such times as may be designated or requested by the Council. The fiscal year of said Museum Board shall conform to that of the Borough of Oakmont.
Such powers as are now or may hereafter be provided by statute of the Commonwealth of Pennsylvania or by ordinances of the Borough of Oakmont, of the County of Allegheny and Commonwealth of Pennsylvania, relating to the development and operation of memorial museums are hereby vested in the Museum Board, to be exercised by it, subject to any and all restrictions contained in such powers and ordinances.
