[Adopted 1-13-1969 as Ch. 70, Art. V, of the 1969 Code]
Any person or persons, companies, corporations or associations now owning or maintaining within the limits of the Borough of Oakmont any gate or gates hung or arranged to open or swing out towards the sidewalks, pavement or street, whereby the same, on being opened, shall in any way swing across the property line of the owner or owners of said property, shall, within 10 days from the date of notice from the Chief of Police of the Borough of Oakmont, remove such gate or gates or cause the same to be provided with suitable appliances to force the gate or gates closed and hold the same in a closed position until actual use thereof as required for the purpose of ingress or egress to and from said property.
From and after the date of this article, it shall be unlawful for any owner or owners of property or other persons to construct gates along property lines or otherwise that, when open, shall swing out toward the pavement or street beyond the property line of such property.
Should it be necessary or the desire of the owner of any gates as mentioned in § 173-23 to reconstruct the fences or gates along their property, it shall be unlawful for them to reconstruct the gate or gates in their former position, but shall reconstruct them in order that they may not swing out, over and across the property lines of the property.
Any person or persons, companies, corporations or associations violating any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $600, plus costs of prosecution, and in default of payment of such fine and costs by imprisonment for not more than 30 days.
