GENERAL REFERENCES

Pursuant to § 1202(35) of the Borough Code,[1] the parties[2] hereto agree as follows:
A. 
This agreement shall replace all verbal agreements and all other agreements and shall constitute the sole agreement between the boroughs and the township on the subject matter.
B. 
The Township of Athens will provide twenty-four-hour fire protection to the Borough of Athens, Borough of Sayre and Borough of South Waverly on a mutual aid system when called by the Boroughs of Athens, Sayre and South Waverly for such purposes.
C. 
The Borough of Athens will provide twenty-four-hour fire protection to Athens Township, Sayre Borough and South Waverly Borough on a mutual aid system when called by Athens Township, Sayre Borough and South Waverly Borough for such purposes.
D. 
The Borough of Sayre will provide twenty-four-hour fire protection to Athens Township, Athens Borough and South Waverly Borough for such purposes.
E. 
The Borough of South Waverly will provide twenty-four-hour fire protection on a mutual aid system to Athens Township, Athens Borough and Sayre Borough for such purposes.
F. 
This agreement shall remain effective between the parties from the date of adoption until December 31 of the same calendar year and shall automatically renew until December 31 of the succeeding calendar year and continue to automatically renew for successive calendar years unless any party in writing shall notify the other parties of its intention to terminate the agreement on or before October 1.
G. 
The parties hereto agree that neither party shall be liable, whether by contract or negligence, for any loss or injury resulting from its failure to render the services herein stated, due to the negligence of its agents or employees or any other party, or due to Acts of God or circumstances arising beyond the control of either party.
H. 
The parties shall implement the system of mutual aid in accordance with a plan developed by the fire chiefs and attached hereto and marked Exhibit A[3] and incorporated herein.
