[HISTORY: Adopted by the Village Board of the Village of Johnson Creek 12-1-1994 by Ord. No. 12-94 as § 1.06(2) and (3) of the 1994 Code; amended in its entirety 7-8-2003 by Ord. No. 20-03. Subsequent amendments noted where applicable.]
Unless another penalty is expressly provided in this Code, any person who shall violate any of the provisions of this Code shall, upon conviction of such violation, be subject to a penalty which shall be as follows:
A. 
First offense. Any person who shall violate any provision of this Code subject to a penalty for which a penalty is not otherwise provided for in this Code shall, upon conviction thereof, forfeit not less than $10 nor more than $250, together with court costs and the costs of prosecution, and in default of payment of such forfeiture and costs of prosecution shall be imprisoned in the county jail for a period not exceeding 90 days.

B. 
Second offense. Any person found guilty of violating any ordinance or any part of this Code who shall previously have been convicted of a violation of the same ordinance shall, upon conviction thereof, forfeit not less than $25 nor more than $500, together with court costs and the costs of prosecution, and in default of payment of such forfeiture and costs shall be imprisoned in the county jail for a period not exceeding six months.

C. 
Continued violations. Each violation and each day a violation continues or occurs shall constitute a separate offense. Nothing in this Code shall preclude the Village from maintaining any appropriate action to prevent or remove a violation of any provision of this Code.
Whenever any person fails to pay any forfeiture and costs of prosecution upon the order of the court for violation of any ordinance of the Village, the court may, in lieu of ordering imprisonment of the defendant or after the defendant has been released from custody, issue an execution against the property of the defendant for said forfeiture and costs.
Chapter 15, § 15-18, Room tax.
A. 
Failure to comply with inspection/audit of records: 5% of the tax.
B. 
Unpaid taxes: 25% of the tax due the previous year or $5,000, whichever is less.
C. 
Filing of false or fraudulent return: 50% of the tax.

Violate state statute § 947.01, Wis. Stats., Disorderly conduct: first offense: bond amount: $175, second offense: bond amount $200, and a domestic abuse surcharge, pursuant to Chs. 66, 814, and 973, Wis. Stats., shall be added/imposed by the Circuit Court in the amount of $100 for all convictions of disorderly conduct where the conduct constituting the violation involved "an act by the adult person against his or her spouse or former spouse, against an adult with whom the adult person resides or formerly resided, or against an adult with whom the adult person has created a child," § 973.055(1)(a)2, Wis. Stats.
(2) 
Violate state statute § 947.012, Wis. Stats., Unlawful use of telephone: first offense: bond amount: $50, second offense: bond amount $100, and a domestic abuse surcharge, pursuant to Chs. 66, 814, and 973, Wis. Stats., shall be added/imposed by the Circuit Court in the amount of $100 for all convictions of unlawful use of any telephone or cellular phone where the conduct constituting the violation involved "an act by the adult person against his or her spouse or former spouse, against an adult with whom the adult person resides or formerly resided, or against an adult with whom the adult person has created a child," § 973.055(1)(a)2, Wis. Stats.
(3) 
Violate state statute § 947.0125, Wis. Stats., Unlawful use of computerized communication systems: first offense: bond amount: $50, second offense: bond amount $100, and a domestic abuse surcharge, pursuant to Chs. 66, 814, and 973, Wis. Stats., shall be added/imposed by the Circuit Court in the amount of $100 for all convictions of unlawful use of a computerized communication system where the conduct constituting the violation involved "an act by the adult person against his or her spouse or former spouse, against an adult with whom the adult person resides or formerly resided, or against an adult with whom the adult person has created a child," § 973.055(1)(a)2, Wis. Stats.
B. 
Violate § 189-7, Worthless checks:
(1) 
First offense: $50 to $250.
(2) 
Second and subsequent in 12 months: $100 to $500.
C. 
Violate § 189-9, Smoking prohibited. Not less than $100 nor more than $250 for each violation except that a forfeiture for a "person in charge" shall not exceed $100 per day.

Except as otherwise provided herein, § 60-1, General penalty, applies to any violation of Chapter 210.
B. 
Any person who violates the provisions of § 210-5 shall be subject to a forfeiture of not less than $120 nor more than $600 per occurrence or violation. Each day such violation or failure to comply continues shall be considered a separate offense.
Chapter 221:
A. 
Traffic Code: state penalties adopted apply.
B. 
Section 221-3A to K, parking restrictions, excluding § 221-3D: $10; if the original forfeiture is not paid within 15 days after the date of violation, or if, within 15 days after the date of violation, the defendant delivers to the Village of Johnson Creek Police Department notice that he or she wishes to contest the violation in court, then a citation shall be issued, the violation for which will result in a penalty of $5 plus court costs.

Section 221-3D, Parking prohibited in winter months: $40; if the original forfeiture is not paid within 15 days after the date of violation, or if, within 15 days after the date of violation, the defendant delivers to the Village of Johnson Creek Police Department notice that he or she wishes to contest the violation in court, then a citation shall be issued, the violation for which will result in a penalty of $10 plus court costs.
