GENERAL REFERENCES
Possession of alcohol by minors — See Ch. 141, Art. II.
Parental responsibility — See Ch. 299.
For purposes of this chapter, the following terms shall have the meanings indicated:
CIGARETTE VENDING MACHINE
A machine or mechanical device used or intended to be used for the purpose of automatically merchandising packaged cigarettes, the operation of which is governed or controlled by the insertion of coins or tokens.
PERSON
Any individual, firm, fiduciary, partnership, corporation, trust or association.
No person shall sell or offer for free distribution cigarettes or tobacco in any form to any person under 18 years of age. No person under 18 years of age shall purchase tobacco in any form.
A. 
Any person who permits cigarette vending machines on his/her premises or sells tobacco in any form shall post or cause to be posted a notice on said machines and at other locations where cigarettes are sold, of a size not less than three inches by five inches, in the following form:
"By ordinance of the Town of Newington, cigarette sales to or purchases by persons under 18 years of age are prohibited."
B. 
Said persons shall place the notice on cigarette vending machines and at other locations where cigarettes are sold, in a conspicuous place, provided that said notice shall not obstruct other notices on the machines or cover the tax stamps on cigarette packages which must remain visible in accordance with state law.
It shall be the duty of the Director of Health of the Central Connecticut Health District/Police Chief, or their designee, to enforce the provisions of this chapter.

The penalty for violation of the provisions of §§ 395-2 and 395-3 of this chapter shall be not more than $25 for the first offense. For the second and subsequent offenses, the penalty shall be not less than $25 and not more than $90.
