A. 
The purpose of this article shall be to promote the health, safety and general welfare of the community pertaining to the regulation of traffic in privately owned common parking areas serving, in whole or in part, any industrial, commercial, educational, institutional, professional, entertainment, recreational or other nonresidential establishment or area used for purposes or functions to which the general public is invited, whether directly or indirectly.
B. 
The term "private parking area" shall include:
(1) 
A parking area for any commercial establishment having an exit or entrance on or abutting or adjoining any highway under local jurisdiction.
(2) 
A parking area for any industrial, educational, institutional, professional, entertainment, recreational or other nonresidential establishment or area which can accommodate 20 or more vehicles.
(3) 
Means of ingress and egress to parking facilities; roads and driveways therein; and buffer zones, setbacks and other open space related thereto.
In order to carry out the stated purpose of this article, the traffic authority of the Town of Newington, pursuant to C.G.S. § 14-311b, is hereby authorized:
A. 
Upon request of the affected property owner, to established traffic controls by signal, sign or other device for access to, egress from, traffic within, and stopping, standing or parking in specified sections of private parking areas, as agreed upon between the property owner and the traffic authority.
B. 
To erect and maintain traffic control signals, signs or devices conforming to the standards of the State Traffic Commission pursuant to such a request, subject to an agreement with the owner or operator of such private parking area for reimbursement to the Town for the cost related thereto.
In addition to other enforcement procedures permitted by law, the Police Department of the Town of Newington is hereby authorized to provide for the removal and storage of vehicles which are parked or abandoned in private parking areas during snowstorms, floods, fires or other public emergencies, or of vehicles which are found unattended in the parking areas where they constitute an obstruction to traffic or where stopping, standing or parking is prohibited, and to charge the owner or operator for the cost of such removal and storage.
Any person aggrieved by the order or regulation made by the traffic authority of the Town of Newington under the provision of § 404-21 may take an appeal therefrom to the Town Council of the Town of Newington pursuant to C.G.S. § 14-313.
