It shall be unlawful for any person to deposit leaves and/or debris from trees, plantings or lawns on to public streets, sidewalks or other public property, unless prior authorization is issued by the Director of Public Works.
Person shall mean any individual, corporation or other entity that has physical possession of the private property or, if it cannot be determined who is in possession of the property, its record owner. If there is more than one person in possession and/or listed as owner, all such persons shall be jointly and severally liable for any penalties imposed hereunder.
In the event that a person deposits any leaves or debris on public streets, sidewalks or other public property, the Department of Public Works shall give written notice to said person to remove said leaves or debris from said areas. If the person fails to remove the leaves or debris within the period of time specified in the notice, the Department of Public Works may remove said leaves or debris, and the person occupying and/or the owner of the property shall be liable for the cost of said removal. If the cost of said removal is not paid within 30 days of billing, a property lien may be filed.
The presence of leaves on a public street, sidewalk or other public property in a configuration or amount not created by natural events of nature shall be prima facie evidence that they were deposited in such areas by the occupant or owner of the private property immediately adjoining such areas.
In addition to the remedy set forth in § 79-3, any violation of this chapter, if not corrected within the period of time specified in said notice, shall be punishable by a fine of $25 for the first offense, $50 for the second offense and $100 for each offense thereafter.
The Department of Public Works, by and through its designated employees and/or agents, shall enforce this chapter and shall be empowered to issue notices and citations as set forth above.
