In conjunction with the codification of the Town's legislation, the Charter of the Town of South Bethany is hereby reorganized, revised and readopted to read as set forth in the volume entitled the "Code of the Town of South Bethany, Delaware," particularly the 1994 copy of said Charter, as so reorganized and revised, being attached hereto and made a part hereof.
The provisions of the Charter adopted hereby, insofar as they are substantively the same as the Charter as it was in force immediately prior to the enactment of the Charter by this resolution, are intended as a continuation of such Charter and not as a new enactment, and substantive changes made prior to this resolution are included in § 1-13. Appendix A, included with and made a part of this resolution and maintained on file in the Town Offices, includes the full text of the Charter as renumbered and codified. All such provisions are hereby continued in full force and effect and are hereby reaffirmed as to their adoption by the Town Council of the Town of South Bethany, and it is the intention of said Council that each such provision contained within the Charter is hereby ratified as it appears in the revised Charter adopted pursuant to § 1-11 above.
The following substantive changes were made to the Town Charter in the process of the codification project:
A. 
Section C-4B(26) (original Section 4.2.26) is amended to change "o+r" to "or."
B. 
Section C-13B(4)(b) [original Section 13.2.4(b)] is amended to change "period" to "prior" in the first sentence.
The provisions of this resolution are hereby made Article II of Chapter 1 of the Code of the Town of South Bethany, such resolution to be entitled "Article II, Ratification of Charter," and the sections of this resolution shall be numbered §§ 1-11 through 1-17, inclusive.
If any clause, sentence, paragraph, section or part of this resolution or of any provision included in the Town Charter, now or through supplementation, shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered. It is hereby declared to be the intent of the Town Council that this resolution and the Charter would have been adopted if such invalid clause, sentence, paragraph, section or part had not been included therein.
All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict.
This resolution shall take effect on the 8th day of September, 1995.
