This Article is authorized by § C-4B of the Town Charter.
A. 
It shall be unlawful for any person to engage in, permit or cause disorderly behavior or activities within the corporate limits of the town.
B. 
For the purposes of this Article, disorderly behavior or activities shall be deemed to constitute a nuisance when such behavior permits or causes any of the following:
(1) 
Fighting or violent, tumultuous or threatening behavior.
(2) 
Unreasonable noise or offensively coarse utterances, gestures or displays or the addressing of abusive language to any person.
(3) 
Obstructing vehicles or pedestrian traffic.
(4) 
Creating a hazardous or physically offensive condition which serves no lawful purpose.
(5) 
Refusing to comply with a lawful order of a police officer to cease and desist any of the aforesaid acts.
A. 
Any person violating the provisions of this Article shall be subject to a penalty of not less than $50, nor more than $100, plus court costs. Each day of continued violation shall be considered as a separate offense.
B. 
After two or more such offenses involving a rental property, the rental license issued for said property may be suspended or revoked at the discretion of the Mayor and/or Town Council. The length of the suspension and revocation shall be determined by the Mayor or Town Council.

Sleeping shall not be permitted on any beach, on private property, subject to the condition that this shall not apply to the owner of such private property or his/her authorized tenants or guests, or in any type of motor vehicle or watercraft located within the corporate limits of the town, between the hours of 11:00 p.m. and 8:00 a.m.
Any person violating the provisions of this Article shall be subject to a penalty of not less than $25, nor more than $100, plus court costs. Each day of continued violation shall be considered as a separate offense.
