This article is authorized by § C-4B of the Town Charter.
A. 
All oceanfront property owners are hereby made responsible for the maintenance of their properties in the manner set forth in this article to alleviate, minimize and avoid damage to the roads of the town, the dunes, sewers and properties of other owners.
B. 
Each oceanfront property owner is hereby made responsible for maintaining a level of land fill on his or her lot of a nature approved by the Delaware Department of National Resources and Environmental Control and to a level at an elevation approximating the level of Ocean Drive and extending toward the waterline a distance of 20 feet from such right-of-way or to the face of the west side of the structure, whichever is the greater distance. Such conditions shall be maintained each successive year.

The town's Code Enforcement Constable and/or Town Manager shall inspect all such properties no later than May 15 of each year and make a written report of every noncompliance to the Council of South Bethany.

Any person violating the provisions of this article shall be subject to a civil penalty of $200, plus court costs. Each day of continued violation shall be considered as a separate violation.
In addition to the penalties prescribed in § 104-4 of this article, each person found to have violated this article shall be liable for all costs incurred by the Town of South Bethany for all actions necessary to place such property in compliance with this article.
