Whoever violates any provisions of regulations of the Board of Health
regarding the sale of tobacco products to minors may be penalized by a noncriminal
complaint pursuant to the provisions of MGL c. 40, § 21D, as amended.
For the purpose of this provision, the penalty to apply in the event of a
violation shall be as follows: mandatory attendance at retailer training for
clerk and owner within 30 days of the violation for each and every offense;
$50 for the first offense; $150 for the second offense; and $200 for the third
and each subsequent offense within a twelve-month period from the adjudication
of the first offense. Enforcement is to be by Board of Health members and/or
their designee.
